Bobby Schindler on Glenn Beck show says they just got this disappointing news. He says this means tube will not back in until then if judge orders it.

No, the judge could not have ordered the tube re-instated immediately. The law reads, "After a determination of the merits of a suit brought under this Act, the District Court shall issue such declaratory and injunctive relief as may be necessary...". The judge first has to determine the merits.

It's not the money. It is the fear that she will regain ability to speak! Also, it is like a custody case in family court...he just likes to stick it to Terri's family. His culture of death attys. are encouraging him due to their radical, left-wing politics with no real interest in the future welfare of Terri!

Money, or lack therof, is the issue . It is my recollection that Schiavo sued for $13 million and promised that money would be used to attempt rehabilitation and to care for Terri. He was awarded 1/10 that amount. He made expensive stabs at rehab without success. He was then forced to reevaluate the situation. He had x amount of settlement dollars left, no hope for rehab, cost of providing quality care for an indefinite time period was beyond his means, Terri was destined for a state run facility in which her care would be minimal at best. Also, included in his factoring was his knowledge of the Schindler's (Sr. & Jr.) dismal finances (before Terri's accident) he knew they could not contribute to her care in a quality facility.
Seeing no hope for brain function improvement and no hope of being able to assure quality care, he succumbed to Terri's wishes.

Then there are the upcoming book and movie contracts -- they will be worth millions. But the final chapter has yet to be written.

hospice care is paid for by either medicare or medicaid...in terri case she has been delcared indigent and medicaid is paying for her care...thats what i have read

According to whom? She's never had a PET scan or an MRI, for Heaven's sake.
In any case, to my mind anyway, legally this is less about her condition than it is about her wishes.
People of sound mind in this country have the right to refuse medical care. But we only have Schiavo's testimony on what supposedly was. And right now I'd say there's one heck of a lot of reasonable doubt about the truthfulness of his assertions.

The dirty little secret that in AARP land, Florida, starving one to death is COMMON practice when they are terminally ill. That is not the situation with Terri. Now the disabled and handicapped and brain damaged are fair game?

You are right -- he has to review the merits first and either issue a ruling inserting the tube until this can be sorted out or rule against at which time the 9th Circuit will get it immediately. Or he could have punted to the 9th Circuit right away.
