Hearsay is testimony that offers an out of court statement for the truth of the matter asserted therein and not allowed under exceptions. Exceptions to the hearsay rule, dying declaration ("Joe Smith killed me") excited utterance ("It was a red car that ran him over!"), act of independent legal significance, ("I don't want to be hooked upton machines").

Thanks for the reply, but one thing that I wonder about.....

act of independent legal significance, ("I don't want to be hooked upton machines").

She allegedly said something like this while they were viewing a TV show about this subject. Now, could that be considered a well thought out Life-or-Death decision? Or was it influenced by an outside stimulus (Like a TV show)?

In other words - Did she REALLY mean it when she said it? For instance, Several years ago, before being admitted for an operation, I had to fill out and sign a Living Will. When I got to that sheet, I had to stop and THINK HARD about the ramifications of what I was about to do/sign.

Did Terri think hard, or was she influenced? Without anything in writing, we'll never know.
