Santorum: Terri Ruling Defied Congress

U.S. District Court Judge James Whittemore has defied Congress by not staying Terri Schiavo's starvation execution for the time it takes him to hold a full hearing on her case, a leading Republican senator said Tuesday.

"You have judicial tyranny here," Santorum told WABC Radio in New York. "Congress passed a law that said that you had to look at this case. He simply thumbed his nose at Congress."

"What the statute that [Whittemore] was dealing with said was that he shall hold a trial de novo," the Pennsylvania Republican explained. "That means he has to hold a new trial. That's what the statute said." "What he's saying is, 'I don't have to hold a new trial because I've already determined that her rights have been protected,'" Santorum said.

"That's nice for him to say that But that's not what Congress told him to do," he added. "Judges should obey the law. And this judge - in my mind - simply ignored the law."

Well for one he's waging a PR war against the MSM and Judiciary, which given the polls, seems to be necessary. The MSM *might* be forced to state the truth of this judges ruling after Santorum's statement.

I thought thats what the judge did, looked at the case and than made a ruling? Congress should have done more than tell a judge to look at a case. Santorum, that's what you guys told him to do.

Exactly. It's fine to whine and whine. But unless/until Congress gets a spine, it doesn't mean squat.

Whatever happened to the "subpoena"? Judge Greer just ignored it. Now this. The courts have arrogated to themselves preeminence over Congress.

Congress has allowed them to do it. If Congress wants its Constitutional status back they will have to assert their powers. The courts will not relinquish those powers voluntarily because certain Congressmen whine. There have to be consequences or the whining doesn't mean squat.

Sooooo what are ya gonna do about it???

1.Attend the March for Justice II

2.Affirm to people that this ia a Clinton appointed judge and find out how much involvement Hillary had in appointing this judge.

3.Start fighting the "Culture of Death" on all fronts -- get Congress to stop funding "Planned Parenthood" and the lies they teach children at all ages in school.

4.Do whatever you can to help Terri right now -- including getting on your knees and pray for her.

Remember you can take the dog out of the fight, but you can't take the fight out of the dog. And small dogs sometime are pretty good scrappers!

Do you want justice. See my tagline! It exists for the chosen few and Teri is not one of them.

Why didn't Ted Kennedy have his sister put to death? She was a financial burden. Why was she special?

To All the Republicans in Congress in the 90s who gave a lot of the Clinton appointees a FRee Ride.. what the hell are ya bitching about it for now?

Judicial Tyranny didn't just plop out of the sky yesterday..

If you do not have the strength and courage to go to the mat for your convictions, then what the hell are you even in politics for?

Congress has been obsolete for years.

The courts run the country.

One liberal maniac in California successfully defied the entire electorate in that state.

In a saner world...heads would roll.......

What happened was that Terri's family asked for a preliminary injunction ordering that the feeding tube be reinserted while the case is pending. In order to get a PI a party has to show that there is a substantial probability that the requesting party will prevail on the merits. The Judge ruled that the family had failed to meet that burden. I think the family should have sought the same relief by filing a motion to preserve evidence. Perhaps they did but I didn't hear anything about it.

No, stopem, Santorum is exactly right. They conferred jurisdiction on a court to hold a trial in this case, and he said he didn't need a trial to decide that the Schindlers had no chance, so he didn't need to issue an injunction. It's as though someone filed a lawsuit, and the judge one day later said he knew who was going to win, without looking at the evidence or allowing discovery or holding a trial.

This judge is so far off that he might just get reversed on appeal.

Congress showed their courage by taking BACK their right to determine the jurisdiction of the courts and are being bashed by the public, MSM and apparently a few frustrated people here for it. They followed their Constitutional rights and I APPLAUD them.

if you wish to bash anyone I suggest you look to the Judiciary, Democrats and Michael. If you wish to go further than that I would suggest the Devil himself.
