Here's the difference: Spy on an enemy, get caught, and if you avoid death, you'll eventually be traded for somebody the enemy sent to spy who got caught.

Spy on an ally, and the rules are different. That's just the way it is. We expect our enemies to screw with us, we don't expect it from friends.

That makes sense too. Respect the enemy, despise a traitor. The only thing is he did not mean to harm the US, just wanted to help Israel. If his info got into the enemy hands, he did not intend it this way.
