Countries with Judicial Supremacy
3/24/05 | Tomahawk

Is anyone aware of any other nation on Earth where judges make the law under the guise of interpreting a national constitution, strike down laws that they don't like, and enjoin the elected officials of government from enforcing laws that are valid and not struck down?

I can't think of another nation that has judicial supremacy, not one.

What a disgrace that our country has devolved into this.

Yes, we ultimately can impeach individual judges, but my point is that the American courts, as a branch of government, have take powers that courts in no other countries have deigned to have.

Canada and Israel, though Canada grants more religious freedom than in both America and Israel (hard as that is to believe).

Read Bork's "Coercing Virtue" for an excellent study on what is happening in America using the Canadian and Israel supreme courts as case studies.

Of course, Bork is saying that it is a very bad example to follow as both countries do have judicial tyranny, and that's where we're headed.

Iran might fit the Tagore though technically they are "religious leaders" as opposed to judges.

I believe that Saddam Hussien was the Supreme Judge in Iraq when he was in power. The law was what he said it was.

There are many countries where the judicial function is combined with the executive and/or legislative- and therefore have a judicial tyranny by definition.

But one where the judicial branch is both separate and superior- like we seem to be suffering from these days- hmmm, can't think of any.

Any Islamic country with Sharia law. The judges are the imams.

judges run the country by means of the napoleonic code = you're guilty until proven innocent.
