MADISON, Wis. (AP) Milwaukee County certified its election results in the 2004 presidential race without reviewing key documents required under state law to verify the vote count in the city of Milwaukee, the state's top election official said Thursday.
The state Elections Board launched an investigation into why the state's largest county approved voting results without receiving the materials after the Nov. 2 election, said executive director Kevin Kennedy.
The investigation could result in a legal challenge to the outcome of the presidential race because the state used incomplete information to certify the results, said state Sen. Joe Leibham, R-Sheboygan. He said Milwaukee County committed ``a clear violation of state law'' and election workers could face felony charges specified under state law.
Under state law, county clerks must receive ballots, tally sheets, voter lists and other election materials from all municipalities by 2 p.m. the day after an election. The county's canvassing board must review that information before certifying the results and sending them to state officials.
``It sounds like none of the information was delivered,'' Kennedy said. ``They were not following the procedures set out in the state law.''
Democrat John Kerry received more than 71 percent of the 277,000 ballots cast in Milwaukee in the presidential race. Kerry won Wisconsin's 10 electoral votes by about 11,000 votes.
Chris Lato, spokesman for the Republican Party of Wisconsin, said the party would wait for the Elections Board to finish its investigation before considering a legal challenge to the outcome.
``Wisconsin is starting to look like the new Chicago of election fraud,'' he said. ``It's conceivable that George W. Bush won Wisconsin. As these numbers pile up, that notion becomes less and less out there.''
Kennedy said Milwaukee city and county officials were cooperating with the investigation, which aims to understand what happened in the presidential election and prevent future violations of the process.
It is the latest election flaw in Milwaukee, where local, state and federal investigators are already looking into a variety of problems in the Nov. 2 election. Published reports have detailed felons who illegally voted, people who used fake names and addresses or voted twice, and poll workers who used inaccurate voter registration lists.
The latest problem surfaced during a hearing Wednesday of a legislative subcommittee investigating election law. After questions from Kennedy, Janice Dunn, administrator of the Milwaukee County Election Commission, acknowledged the county never received the information from Milwaukee in the 2004 election or other elections.
Milwaukee County's three-member canvassing board instead relied on the results as they were provided by the city, Dunn told lawmakers. Dunn declined comment Thursday.
Leibham, who leads the committee, said lawmakers were stunned by her admission. He said it ``just begs huge questions in regard to the credibility and validity of Milwaukee County election results.''
That's saying a lot.

Don't live in the City of Milwaukee, but am in Milwaukee County. One bright hope is the Republican County Executive. The rest of the powers that be are pretty much worthless!
The rats in Milwaukee didn't need to count the votes. They only needed to know how many votes Kerry needed to win. Why bother with the whole tedious thing?
We had a number of Illinois volunteers help us on election day, and they were uniformly shocked about the way elections are conducted in Wisconsin.
Same day registration, no requirements for identification of voters, and extremely lax registration requirements, including the ability of one voter to "vouch" for an unlimited number of others, has led to a situation where election fraud takes place on a wholesale basis.

Very well, thanks. I've really been out of pocket for a while. Daughter, son-in-law and three grandbabies arrived here around the end of January from a two year tour on Guam. They were here, off and on, for about three weeks of visiting and getting reacquainted with the little ones. We had a ball! Grandkids are truly God's way of giving old folks another chance at getting it right since some of us(guilty!) were too busy making a living to really appreciate our own little ones.
In any case, after their visit with son-in-law's family for about three weeks, they were on their way to the Azores for another two year tour. They no sooner arrived there when son-in-law's younger brother(26) had a fatal brain hemorrhage. Son-in-law is trying to make his way back to Texas even as we type. His brother was a great guy and dearly loved his nephews and niece(the grandbabies). Maybe because he didn't have a family of his own. May he rest in peace.
