Thomas More Law Center Response to Jeb Bush Request for Opinion on Schiavo Case supplied 10/15 2003

Read it for yourself and be appalled at Gov Bush's inaction for over 2 years. He knew over 2 years ago that DCFS had the power to take custody of Terri.

He knew that there was a strong posibility that abuse and neglect was taking place over 2 years ago.

From page two, typed by me:

"In the final analysis, the fact of this case clearly establish probable cause to conduct a full criminal investigation of the circumstances surrounding the disability of Ms. Schiavo. To date, the facts of the case have not been viewed through the lens of a criminal investigation."

"Ms. Schiavo's life is at stake. Therefore you should take immediate custody of Ms. Schiavo... direct the Florida Department of Law Enforcement to conduct of full investigation of the facts and circumstances of this case, to include secuyring search warrants and interviewing witnesses, including medical experts, and take measures to prevent future harm to Ms. Schiavo pending the outcome of the investigation. "

I agree. If he had this info for two years and just sat on it then he's not worthy of being governor. Go find another job.

Thomas More (sic) Law Center is far far far away from the state of Florida. I've never been too impressed with their lawyering.

it seems so typical of the Bushes to me. privileged rich guys who have never had to worry about anything and have nothing in common with the rest of us. they willl never have to worry about their medical care or anyone pulling THEIR plugs. both of the Bush brothers disgust me at this point. either of them couuld save Terri and could have days ago. and yes...Jeb Bush has known about the situation surrounding Terri for years now and chose to do....NOTHING. at least he is being consistent.

Regardless of what side you're on in this debate, this is an asinine accusation.

If we accept the court as the final authority, then our country is doomed, judging by your comment, you seem content with that. May God have mercy upon us all, for we surely need it.

No where in any statute does it say that the governor or DCFS has to get permission from a judge to take emergency action.

This what does this mean? "In the event you employ this procedure, the Department must petition a court for an order authorizing emergency protective services within 24 hours after arranging for the emergency removal of Ms. Schiavo See Fla. Stat. 412.1051 (2)(b)"

Notice it says "must petition "a" court, NOT Greer's court. He can go to any court and get the order without any problem because it's within his authority.

24 hours after they act, thay have to inform the court, and then go through due process to determine what happens next.

The statute says they have to petition the court within (IIRC) 48 hours afterwards. So far, so good. Unfortunately, Greer saw this coming, and beat them to the punch by issuing a restraining order, first. Now, it's complicated -- and which branch decides on complicated issues?
