Gov. Bush said Friday that a prosecutor has agreed to investigate why Terri Schiavo collapsed 15years ago, citing an alleged time gap between when her husband found her and when he called 911.
Bush said his request for the probe was not meant to suggest wrongdoing by Michael Schiavo. "It's a significant question that during this ordeal was never brought up," Bush told reporters.
As CBS Correspondent Wyatt Andrews reports, Michael Schiavo's attorney calls the new investigation political pandering by the governor.
"It's just shameful and disgraceful that Governor Bush has for years used this case to perpetuate his own agenda,'' said attorney Felos.
In a statement issued by his lawyer, Schiavo called the development an outrage.
"I have consistently said over the years that I didn't wait but 'ran' to call 911 after Terri collapsed," Schiavo said in the release.
In a letter faxed to Pinellas-Pasco County State Attorney Bernie McCabe, the governor said Michael Schiavo testified in a 1992 medical malpractice trial that he found his wife collapsed at 5 a.m. on Feb. 25, 1990, and he said in a 2003 television interview that he found her about 4:30 a.m. He called 911 at 5:40 a.m.
"Between 40 and 70 minutes elapsed before the call was made, and I am aware of no explanation for the delay," Bush wrote. "In light of this new information, I urge you to take a fresh look at this case without any preconceptions as to the outcome."
McCabe was out of state Friday and couldn't immediately be reached for comment, but Bush said McCabe has agreed to his request.

Okay, before I say this, I'm going to say that perhaps I shouldn't. Still...

This was a figurative comment, and should not be confused by anyone as an admonition to actually do so.
This whole case hinged on the credibility of Michael Schiavo. His word that Terri would have chosen to die alone was the sole basis for the order to stop feeding her. Yet he admits to being confused about material facts in the case. If he delayed calling 911 there are two consequences. First, his malpratice lawsuit was fraud. And second, he certainly will be shown to have been the last person the law should have allowed to make critical decisions about the fate of Terri, as he'll have been to have botched that already (intentionally or just due to stupidity).
I think if I were dear Michael, I would be just a tad worried, thinking he got away with murder.
You remember when Mark Ferman went to Mass. to write a book called "A Murder in Brentwood" well he has been in Fla. and has written a book about Terri, just with that information, Michael should be shaking in his boots about now, I would think.....after all, after 30 years, the Kennedy clan member that killed this girl is in prison right now, nothing better will be tolerated for dear old Michael.
After the way he treated Terri's family, not to mention Terri herself, I hope this scum is harrassed and made miserable for the rest of his sorry life.
I am waiting to see if the insurance scam? about the initial treatment of Terri is going to bear up under intense scrutiny..

When I heard that Terri Schiavo had been bulemic, it occurred to me that her husband might have encouraged it by making snide comments her about her weight. If so, I think that would be the extent of his involvement in what happened to her.
About time. What's to fear, Mikey, you've already disposed of the real evidence with the judicial system's complete aid.

Tough cookies, Michael. If you didn't ask so mean and ugly all the time and were a little more considerate of you late wife's family, people wouldn't be suspicious of you. You've brought this all on yourself. BTW, have you married the mother of your children yet? What is stopping you now?

Michael very well might have thought Terri was dead. It took the paramedics more than a half hour to get her breathing again.

It's my opinion that Michael's credibility should have been a bigger factor to Greer's finding of fact that Terri wished to die. A delay in calling 911 would play into that credibility factor.
It's moot for Terri, but worth pondering an adjustment to the legal system for life and death decisions in civil court. As it stands, it takes MUCH more "effort" to correct erroneous findings of fact, than it takes to make the finding in the first place. In the cases of incapacitated patients, a life/death outcome hangs on the finding.
Let's be fair. How many of us would want to be prosecuted for an event 15 years ago after professionals (physicians) had stated that there is no evidence a crime had occurred?
