If I were the nominee and were asked if I thought it was activist to ignore stare decisis, my answer would be, "No, senator. Where the Constitution is in conflict with recent decisions, I believe in the stare decisis ANTE."

Unfortunately we also have to ask, since when does this President care about the Constitution?
He likes to talk about the Constitution in abstract, "go, freedom!" lip service terms during elections. That's for sure. I believed him in 2000.

Yes he was and it got me to thinking. The despicable Dems have shifted the nomination process to a democratic style political campaign and members of the court like Sandra Day O'Connor at Kennedy have changed the process of the court to one of a legislative body!
She delighted in wheelin and dealin and playin both ends against the middle and the press ate it up too! I'm really saddened to say that both Ronald Reagan's appointees have really let his legacy way down.
Obviously Judge Bork was his prime choice and even the Gipper's advisors and coaches were totally outsmarted by the Kennedy/Biden cabal.
That ol Mormon from Utah has turned into a real lame. In fact, the entire Republican contingent in the US Senate, especially people like the seven reprobates and Lott act like a bunch of sick puppies that like to chase cars and then don't know what to do when they catch 'em!!!

A textualist like Scalia would also be acceptible, although I would prefer an originalist like Thomas. It is a distinction with enough difference that it is worth noting, although I think Rush uses the terms interchangably.
