JAFFREY, N.H. -- Illegal immigrants charged with criminal trespassing by two New Hampshire police chiefs will have to wait for a decision that could set a national precedent on whether local law can be applied to people in the country illegally. Jaffrey District Court Judge L. Phillips Runyon III yesterday said he would continue to study the matter before ruling on the case against eight illegal immigrants charged by a police chief in Hudson, N.H., with trespassing.
"I know there are many people anxious to have a decision," said Runyon to a courtroom packed with journalists, defendants, relatives, and Latino civic leaders and representatives from local human rights organizations. "But because of the complexity of the case, it warrants further consideration on my part."

How can this possibly be hard? The law in New Hampshire is clear and we know he is an illegal immigrant.
What a stupid argument - the local police are enforcing local laws, it just happens that the perps are illegal aliens. Since when does being illegal in one area immunize one from laws in another area? The polution argument is a real hoot - the illegal activity isn't happening in another state, it's happening right in the jurisdiction of the police enforcing it. Hopefully the judge has even one iota of a brain cell.

Because the federal government will not allow local law enforcement to enforce this federal law. That is how ass backwards the government is on this issue. Does this mean because bank robbery is a federal law that local law enforcement cannot apprehend the suspects?
The Bush administration is an open borders regime. DO NOT fall for any crumbs they throw their base on this issue. If they were against these law breakers they would have been fighting this issue from the beginning.
Vote Tancredo or the constitution party before it is to late.

Because outside Constitutionally enumerated areas, the federal government and the states have concurrent, not OVERLAPING jurisdictions.
And, because illegals are 'residents'....not *citizens* , they are protected by law.
I can hardly wait for this case to be decided. I've been watching and waiting. Either way it's decided, it will set a precedent for all cases after it. I don't envy the judge, if he does what I think is right (they have no legal right to be here therefore they are trespassing) he will have President Bush, LaRaza and the ACLU after him. And of course they will immediately hmmm, what's the word, want to refile and take it to a higher court.
This is such an important case, if it goes thru that will give all other states (which I also understand are closely watching this) the ability to go after their illegals on the same grounds.
Also I read in a previous article regarding this that the Mexican government is paying legal fees for the illegals charged. I bet this judge wishes it wasn't happening in his court.

If a bank robbery, which is a federal crime, is in progress in any city in the United States, who is usually the first to respond to it? That city's police department. Since bank robbery is a federal crime, perhaps the local police department shouldn't bother responding to a bank robbery in progress and should instead call the FBI and wait for them to respond to it.
Makes no sense - if an illegal immigrant robs a convenience store in a State, the local police can arrest and hold the guy - this is justan attempt to further blur the laws and make it easier for the ACLU commies to have their way.
That' s right...because theft is a crime.
Theft is not in the same class of *crime* as crossing the border illegally......illegally entering the US is a MISDEMEANOR.

The ACLU has been able to accomplish what it has because so many Americans are just totally ignorant of the way our 'laws' works.
