Is it true that the ACLU gets paid by our own government to sue ..... anyone or anything?

I heard on a talk radio program some time ago that congress passed a law sometime back that the ACLU actually gets paid our own tax dollars to sue the government, win or lose.

My question to the group .... Is this true and if so do you know the bill reference so I can read the details?

This is true. It was added in the late 60's. They get paid if they prosecute if a civil right is violated. So naturally, they've been claiming it everywhere.

The ACLU should be disbanded.

Any settlements they reach in cases usually involve them getting legal fees paid for, so yes, they do in a sense get paid by the government bodies they sue, and ultimately, the taxpayer. Sucks, don't it?

Not a subsidy per se, but if ACLU wins in court, the civil rights statute they usually sue under, 42 U.S.C 1983,1988(as I recollect) allows the prevailing party to recover attorneys' fees from loser, that is, the taxpayer.

The information you were given is incorrect. However, the ACLU does receive money from the government in some circumstances. While I don't remember the particular legal citation (and thus can't give you a link), the situation is this:

If any organization sues in a civil rights suit, and wins, the judge in the case has the option to award that organization its legal fees from the taxpayers. Losers don't get anything, and the judge doesn't have to pay off the winners if he or she decides not to.

The ACLU indeed makes an absolute fortune in taxpayer funds while it destroys the US misusing our own laws.

Actually, yes.

As a matter of fact, the ACLU is picking up a check today to finance a campaign against some poor schmuck named Russ in North Carolina.

It will suck to be that guy!

Now you see why the ACLU is so lawsuit-happy.

Basically ACLU attorneys get a double paycheck - one from the government, and one as an attorney who wins a lawsuit normally gets (percentage of damages).

Someone please tell my how such payments are Constitutional.... please.....

The ACLU can not collect attorney fees in its Boys Scott suits since the BSoAs are not a government agency- Correct?

It has nothing to do with whether or not the entity being sued is a government agency. If someone is being denied their civil rights, and an organization such as the ACLU steps in and sues and wins, the judge in the case can reach into our pocket to pay their legal fees.

In cases where someone actually is being denied their civil rights, they often don't have the money to hire attorneys. This enables people who really have been denied their civil rights to have a chance to get legal representation. But then, unchecked, you get what we have now.
