New Orleans Begins Confiscating Firearms as Water Recedes

NEW ORLEANS, Sept. 8 - Waters were receding across this flood-beaten city today as police officers began confiscating weapons, including legally registered firearms, from civilians in preparation for a mass forced evacuation of the residents still living here.

No civilians in New Orleans will be allowed to carry pistols, shotguns or other firearms, said P. Edwin Compass III, the superintendent of police. "Only law enforcement are allowed to have weapons," he said.

But that order apparently does not apply to hundreds of security guards hired by businesses and some wealthy individuals to protect property. The guards, employees of private security companies like Blackwater, openly carry M-16's and other assault rifles. Mr. Compass said that he was aware of the private guards, but that the police had no plans to make them give up their weapons.

Nearly two weeks after the floods began, New Orleans has turned into an armed camp, patrolled by thousands of local, state, and federal law enforcement officers, as well as National Guard troops and active-duty soldiers. While armed looters roamed unchecked last week, the city is now calm. No arrests were made on Wednesday night or this morning, and the police received only 10 calls for service, a police spokesman said.

The article says non-law-enforcement will not be allowed to carry firearms, but the headline says they are being confiscated. On another yahoo group several people reported that ABC News had film of Police and/or National Guard doing entry and search house by house to get all the guns out.

So, now we do get to see the "nightmare scenario" that many RKBA advocates have feared for years. Police backed by Army doing house-by-house search and confiscation.

Did they declare martial law? If not, they have no authority to do so.

I have heard various versions of the ML declarations.

Does anyone know if ML has been officially declared?????

I wonder if they have some list or if they are just asking? If they are just asking, clearly the answer is "No, no guns here.".

I could be wrong but, I seem to recall hearing martial law declared on the day or perhaps the day after the hurricane hit.

lots of other stuff, but not about Martial Law

Again per the ABC News video (which I did not see first hand) they were showing up with zip ties in hand, forcing the people to stand on their porch while the houses were searched.

"People are using that term far too loosely," said Duke University School of Law professor Scott Silliman. "Martial law can only be imposed by a governor or the president of the United States when there is a total absence of any governing authority (meaning no courts, etc). Martial law allows the federal military to come in to preserve the country."

This has not happened.

I'd love to know the basis of their right to confiscate the legal firearms of law-abiding citizens.

Has the 2nd Amd been repealed on private property in New Orleans?

When was martial law declared?

If you had a little warning, you could grab a shovel and dig a hole in the backyard.

I think we all kind of knew that the Constitution is well and good when things are going well but when circumstances hit the fan, I think we can all now have confidence that all bets are off. Plan accordingly.

Yes. I was thinking along a similar line that in this case having simply stored them in a weighted waterproof case (like a Pelican) would put it under the dark water and out of reach of the gun grabbing LEOs.

It sounds like they are looking at the registrations and making sure they get those guns. If you resist, you will be arrested or shot. Doesn't sound like anyone is resisting.
