Illegal Aliens Charged In Rape

MOUNDSVILLE - Two men who claimed to be illegal immigrants from Mexico working at the Wal-Mart Supercenter construction site in the north part of the city were charged Saturday with sexually assaulting a woman for over an hour in the suspects' room at the Plaza Motel. Francisco Aguilar Salvidar, 29, and Martin C. Ramos, 38, each were arraigned on one count of second-degree sexual assault by Marshall County Magistrate William D. Anderson, who set $25,000 bonds on the men.

Both suspects remain lodged in the Northern Regional Jail, according to an official with U.S. Immigration and Customs Enforcement and city police; however, a jail official early Monday did not have Ramos on the register of inmates and it was reported that the suspect had been released.

The suspects listed their addresses as Room 23 at Plaza Motel, located at 1402 Lafayette Ave.

According to the criminal complaint filed by city police Patrolman Steven P. Kosek, officers responded to the motel around 4:40 a.m. Saturday on a call of a disturbance. Officers had responded to the motel about an hour earlier on a call of a man banging on a door to one of the rooms, though the alleged victim was not at the scene at that time, said city police Lt. David Robinson.

The alleged victim reportedly went home for a while and discussed the incident with her husband before she decided to pursue criminal charges, Robinson said.

When officers arrived on the disturbance call, they met with the alleged victim and her husband. The woman said she was raped by "two Mexicans" in Room 23. Officers went to the room and spoke with Aguilar, Ramos and another man. None of the men were fluent in English, but Aguilar was able to tell officers "that they worked at the Wal-Mart site" and "were in this country illegally." Aguilar further told officers "that there were some girls looking for drugs at their room earlier."

All those involved were taken to headquarters, where the alleged victim completed a written statement. In it, she said she was at the Guest House Bar dancing with an "older-looking Mexican on and off all evening." Near closing time at the establishment, the woman stated, the man grabbed her by the arm, "said something in Spanish" and led her up to Room 23.

When the two entered the room, the woman told officers, she saw a second, younger male and decided to leave. At that point, the older male allegedly pushed her onto the bed and he and the younger man began to sexually assault her while she kicked and screamed. According to the report, one of the men used a plastic garbage bag as a condom.

The woman said she was allowed to go to the restroom at some point during the incident, and the men tried to follow her. The woman said that while all of this was going on, she could hear someone knocking on the door. When the woman came out of the bathroom, the men tried to push her onto the bed again, but she was able to put on her clothing and called her husband by cellular telephone to tell him she had been raped, the report stated.

The woman later identified the suspects by photographs shown to her by police. A translator was called in to collect the suspects' personal information, the report stated. The alleged victim was reportedly taken to a local hospital, where a rape kit was administered.

Robinson said the department has been in contact with ICE regarding Aguilar's claim that they were in the country illegally.

"We're passing information along to them for their investigation," he said.

Michael Gilhooly, spokesman for the ICE Law Enforcement Support Center at Williston, Vt., said the agency has placed federal immigration detainers on the suspects, meaning that if they were released from the state's custody, they would be transferred into federal custody.

"The initial indications are these individuals are in the country illegally," Gilhooly said.

Federal agents will interview the suspects in order to confirm their identities and determine how they entered the country, where they were employed and where they have lived.

"None of those things is known positively," Gilhooly said.

The state charges against the suspects must first come to completion before any immigration charges can be pursued, Gilhooly said.

Mark Small, chief financial officer of Cleveland Construction Inc., the general contractor of the construction project, said Monday that neither suspect was listed as working for the company, nor were their names immediately discovered on the corporate payroll of around 2,500 employees.

In their financial affidavits seeking court-appointed counsel, the suspects claimed to be paid a monthly, undeclared cash salary of $1,200 by an unspecified employer.

Small said that around 15 subcontractors are currently working at the site and that each employee hired by a subcontractor must present a form indicating they are of legal working status. Small said the site superintendent reviews the forms in order to make sure the subcontractors are in compliance with federal and state law.

"To work on the site, we look at everyone," Small said. "Every new body has to have (the forms). We will be looking into this further."

Here is a case of a large contractor hiring subcontractors who in turn hire illegal aliens (did you get that?) who just happen to get slammed with rape charges.

On top of that, of the two brought up on rape charges were arrested and - ONE WAS RELEASED AND CANNOT BE FOUND!

I dont see in the story where one was released... at least I hiope he wasn't -this is pretty much the textbook definition of flight risk.

They used to hang pirates by the ocean, so that passing sailors would see justice.

It didn't stop piracy, but it was very poetic. I wonder why we don't hang rapists by the border, so when illegals come over, at least they will know what a hanging rapist looks like.

And my friends don't understand why I'm a Second Amendment sister. It's stories like this that convinced me a long time ago that I would protect myself.

Of course, I don't go to bars and dance with older Spanish men - but I refuse to let that part of the story distract me from the fact that despite her presence in a bar or other behavior that I might consider inappropriate, she was raped. I refuse to blame the victim.

I detest illegals. I agree with Sabertooth (long departed from hereabouts) that there should be a $50 bounty on each illegal for turning them in, and they'd be crossing the border, headed South so fast it would make our hearts sing with joy. I wonder why ICE couldn't institute such a simple program?

No Walmart is just a great business, their employees are
just doing the stuff that non-Walmart employees refuse to do! We will never see the end of this ,this is just the begining. The mexican work ethic is really something though
they dont miss a trick, one full hour of rape, a testament to their diligence and stick-to-it-iveness. A garbage bag for a condom, I guess they just make do with the items at hand. Walmart and their contractors must really be proud of the value they deliver to their customers!
