Opposing lawyers share thoughts on Schiavo case

The only issue that David Gibbs can ever remember Jesse Jackson and Rush Limbaugh agreeing on was the fact that Terri Schiavo should remain alive.

Will there be another Terri Schiavo? The resounding word from those in the trenches of advance-directive law is yes.

"I can't imagine that there couldn't," said Karmen Hanson, an end-of-life policy analyst with the National Conference of State Legislatures. "It all depends on how the laws are interpreted."

I was reading another thread on FR about Tom Delay...seems the judge in his case is Bob Perkins. Bob Perkins is a Clinton appointee who has donated to Moveon.org, John Kerry, and the DNC. Tom Delay may get a real clear picture on how these judges operate. Some of these judges twist the law to make the outcome suitable for themselves. At least Delay is able to hold them accountable, unlike Terri and judge greer.

"Since the Florida officials are avoiding their responsibilities and duties to their office, I am taking them one at a time to the appropriate authorities for removal", Timmerman says, posturing that they have violated their oath of office and betrayed the public trust in advocating the death of Terri Schiavo.

Timmerman says that he followed the proper constitutional procedure in seeking the impeachment of Judge George Greer, submitting complaints to Rep. Allan Bense, speaker of the Florida House of Representatives, and to Rep. David Simmons, chairman of the House's Judiciary Committee.

Judging by the language used in the living wills in nearly half the states, they appear solely created for the pro-death purpose of refusing or withdrawing medical care and treatment. Both North and South Carolina entitled their living wills as a "Declaration of a Desire for a Natural Death." Other states like Illinois, Iowa, New York, Rhode Island, Virginia and Washington articulate an aversion to "prolonging the death process" without requiring the patient actually be dying.

Tallahassee, FL--The Patient Self-Determination Act (PSDA) was signed into law to provide patients admitted into health care facilities with two basic concepts--health care decision-making rights, and the facility's policies in regard to recognizing advance directives.

The advance directive is the legal document which allows your guardian to make health care decisions when you are unable to speak for yourself. Examples are whether you want a ventilator, resuscitated, and lately, starved and dehydrated to death.

Legal And Ethical Considerations

When there were alleged ethics violations concerning Pinellas County probate judge George W. Greer of the Sixth Judicial Circuit Court, attorney general Charlie Crist didn't seem concerned.

And Crist didn't seem concerned when there were alleged campaign finance and elections law violations in Greer's reelection campaign.

Since the court-sanctioned death of Florida’s Terri Schiavo, the conversational media and written press have predictably and (almost) obediently echoed sentiments of self-proclaimed bioethicists in touting living wills as a measure to ensure that one’s own autonomy and personal directives are observed and held fast to in times of medical crisis.

Using the unfortunate Terri Schiavo as their unconsenting poster child, a good many media outlets and bioethics ‘experts’ have screamed from the rooftops that no one should ever allow a fate such as hers to befall them. In other words, sign your life away now so that no one can fight for it later, should you become unable to speak for yourself.

Thanks. Not what I thought it would be - intimidation. Writing letters are seen as a threat, yet denying therapy, food and water to a disabled person are OK (and demands no back talk!).

The lawyer who headed Gov. Jeb Bush's legal battle to intervene in the Terri Schiavo right-to-die case is on track to become a judge in Brevard County.

Kelly Jo McKibben, 37, of Melbourne was selected a finalist for two new judgeships in Brevard on Monday -- one in the circuit bench and the other in the county court.

In Greer's Sixth Circuit, Gov. Bush awarded judgeships to a few candidates who let Terri die, i.e. Carassas and a judge who comes from the Battaglia & Ross Law Firm. There's no more powerful GOP lobbyist than Battaglia the elder. He lobbies in DC all the time. The death care system provides excellent employment opportunities for judges and attorneys who turned Florida into The Starvation State.

I have no respect for Jeb Bush but expect to see him holding a presser as Wilma approaches Florida. (note that he will have Tom Gallagher w/him, not Charlie Crist. I'm not fond of Jeb but apparently, Jeb is not fond of Charlie Crist. At least Jeb isn't dumb enough to stand next to Charlie Crist).
