'The nomination of Harriet Miers has not rid us of the repugnant situation that a jurist with a clear and distinguished record will not be nominated for higher service. This nomination did not rid us of the apprehension of stealth nominees.' That is certainly one of my biggest concerns. For almost 20 years, no Conservative with a track record has been a safe nominee, no matter how accomplished and honorable they are. It was time to have that fight. Bush flinched.

Yep, but there is no problem getting ACLU activists nominated to the highest court in the land. When will the GOP learn to fight?
