Request for 7/1/05 911 Tape Rejected by County Attorney

CHARLES CITY — Floyd County Attorney Marilyn Dettmer this week rejected a request for the July 1 911 recording of Noel Miller reporting her daughter missing.

In declining the request, made by The Globe Gazette and Waterloo-Cedar Falls Courier, Dettmer cited Iowa code, stating it was part of the murder investigation.

“The 911 tape in question became part of the Evelyn Miller murder investigation,” Dettmer wrote in responding to the request, “and all of that is being kept confidential, as you well know.

“I believe that disclosure of any part of that investigation would plainly and seriously jeopardize the investigation and could certainly cause a danger to the safety of some individuals,” Dettmer said.

I'm surprised it took 3 months for someone to ask for the 911 tape.

I've always felt that publishing 911 calls was yellow journalism at its worst. If the content of the tape is evidence, fine -- the judge has it. The only possible result of releasing it to the public is to upset people to no purpose.

Yeah, you are right. Releasing the tape of the 911 call isn't really a good idea but, Dettmers quote is rather strange. How could a 911 call be dangerous to "certain individuals"?

I assume that statement means that the caller named a suspect. However, since there has not been an arrest, the authorities must believe either that the information was in error, or that there's not enough evidence yet to make a charge that will stick.

Either way, public hysteria cannot possibly help the chances of an eventual conviction of the killer.
