Problem with "average" American is that they are highly likely to rule on cases with emotion (Liberal rulings).

Let's all come down off the cross, shall we? Carswell's nomination went down in flames and so will Miers'. Let's just get it over with sooner rather than later. Carswell's replacement was Rehnquist, and likewise we might get someone far better than Harriet the next time.
