A suspended Minnesota Vikings player is the defendant in a civil suit filed today in Hennepin County District Court.
A 21 year old Richfield woman is accusing Onterrio Smith of sexual assault in another Vikings apartment on June 12, 2004.
In an exclusive interview with 5 EYEWITNESS NEWS, the womans attorney spoke about the case and the victim.
I think shes a credible person. Ive talked to her family members who saw her the night that it happened. Ive seen the medical records. I think shes believable, said attorney Lori Peterson.
The victim alleges that she was drinking with Smith and another Vikings player when she passed out. She later woke up and said both players were on top of her. The woman has fetal alcohol syndrome.
Onterrio Smith was suspended when he was caught going through an airport with a whizzinator, a device used to beat drug tests.

Those Vikings... living up to their name?
Dont be so quick to judge.. remember the Kobe Bryant case.
Same guys that were on the cruise ship that had the sex party?
"She later woke up and said both players were on top of her. "
How would that work? I've been trying to envision the scene. How big is this woman?
June 12, 2004???????????
Toss the asault charge.
Too late to whine about it now.
But, toss him out of the league for carrying that whizzinator.
Way to justify all those taxpayer dollars for your stadium, fellas....
Yeah, and HE thought it was used for paternity tests....joke's on him!
What's the over-under on Tice's remaining time as coach? Ticket-scalping, losing record, public sex on the boat, and now this.
Someone's gotta be thinking its time to make a change up there.
He thought he was trying out for a new Capitol One commercial.
Defies the laws of physics doen'nt it????
Boy, that title gave me a Monty Python moment...
Seems funny that the media would take this seriously but not Juanita Broderick!
Bad coach ---- I still cannot get over that he planned his whole offensive strategy (in year's past) on the "RANDY FACTOR"
Which may explain why they are doing so badly now.
and for being named after a Canadian province.
That's what we thought with Clinton too.
I'm sorry they ruined your good name, Sir!
You were the BEST the game had to offer men.
You don't have much of an imagination do you? (:-)
Classy operation, eh?

Ex-Viking Ted Brown's Trial Moved To Stearns Co.
(AP) St. Cloud, Minn. The sexual assault trial of former Minnesota Vikings running back Ted Brown has been moved to Stearns County and is scheduled to begin in late September in St. Cloud, Minn.
Mille Lacs County District Court Judge Michael Jesse will preside.
Brown was indicted by a Mille Lacs County grand jury in late 2003 on first-and third-degree criminal sexual conduct charges after an incident at a team function on Lake Mille Lacs. He remains free on bail.
Brown is charged in a February 2003 incident during the Vikings' annual Arctic Blast event at Eddy's Resort. Prosecutors allege that Brown forced sex on an intoxicated woman who was unable to consent.
The incident was one of two during the Arctic Blast that led an investigation into sexual assault allegations. A separate grand jury investigated allegations that a different woman was assaulted after socializing with players in the hot-tub area of the motel. The grand jury did not issue an indictment in that incident, and the woman settled her claims with the team.
you go out drinking and getting blotto drunk in some jock's pad, and he has sex with you and you're surprised because....?
(No! It's Viking KITTY, stupid!!!)
I'll be he's gone by about mid-season, if not sooner.
Was he on the Love Boat?
"Suspended Viking accused of sexual assault"
I'm so disappointed. Vikings and and those mango chutney eating cavemen star in the funniest tv commercials.
I love the Vikes. Their doing more to derail the stupid and perpetual stadium funding schemes here in MN than anything (or anyone) else. As long as they continue to advertise what criminal scum they are, they'll have NO allies (in either party) in the endless gambits to tax us for yet another new playpen.
These professional atheletes seem to have learned nothing over the last ten years. The first step when any of this crap starts to surface-HIRE ANNE LEWIS AND THE REST OF THE CLINTON TEAM. You will quikckly see the "Nuts and Sluts" defense put in to effect. In fact Tagliabue should put some of the Clintonistas on retainer.
Vikings' 2005 troubles continue

Running back Onterrio Smith was suspended for the season by the NFL in June for violating the league's substance abuse policy, not long after he was caught with a drug-evading device known as the Whizzinator at Minneapolis-St. Paul International Airport.
Receiver Kelly Campbell was arrested in February in Atlanta on suspicion of possession of marijuana and theft by receiving stolen property involving a handgun. Campbell, released by team last month, reached a deal to avoid a trial.
All-Pro defensive tackle Kevin Williams has pleaded not guilty to misdemeanor domestic assault following his arrest in an Aug. 28 fight with his wife.
Offensive linemen Bryant McKinnie and Marcus Johnson were arrested Sept. 26 after refusing to leave Bobby and Steve's Auto World in Minneapolis. McKinnie and Johnson were charged with misdemeanor disorderly conduct and obstruction of justice. They have pleaded not guilty.
Maybe the Vikings players will be able to play for the prison team someday.
Even just on his Wizzinator I can arrive at that conclusion.
The basic law of physics is, don't drink and drive, also if female never drink and....
I knew it, as soon as Moss left the morals of the team were destined to go down./sarc off
Then we could have "Longest Yard Three".
Found on the net:
Sing to the theme from Gilligans Island...
>Come sit right back and you'll hear a tale
>A tale of fateful trip
>That started from a small lake town
>Aboard two tiny ships
>The mates were a bunch of pole dancers
>But the waitstaff was too pure
>The Vikings team set sail that day
>For a three hour tour, a three hour tour
>The action started getting hot
>The dancers strutted their stuff
>If not for the prudes in the fearless crew
>There wouldn't have been such a huff
>The boats turned around and went back home
>The authorities came aboard
>But fear not friends, 'cause all's not lost
>The Vikings finally scored!
"Then we could have "Longest Yard Three"."
Yeah, but as lousy as the Vikings are this year, the guards would probably win.
They did manage to beat a bunch of homeless guys from New Orleans, but that's about it. The Bears will probably wipe up the field with the Vikings this weekend. Feh!
Yeah, that's what I was thinking. How could that Happen? I'm not defending these two alleged "attackers" by any means but this does bring into question her credibility.
"Tice says they are gonna win this weekend. For whatever that's worth."
Well, if his players don't bother listening to him, I'm sure not going to. The Bears aren't much this season, but I think they'll manage to pull it off.
I'm disgusted with the Vikings. No stadium for them.
Here's an idea. Let's just move them to Los Angeles. That city's looking for a football team, and they have a lousy stadium, too. Ship 'em there, Zygi, Tice, and the rest. Good riddance.
However, the Lions will probably still allow the Vikings to perform "godless" acts upon them.
"Good idea. They could make porn movies during the week and play football on Sunday. Zygi could get a heck of a return on his money that way."
