DeLay likely to be booked this week

AUSTIN — Rep. Tom DeLay will likely be booked in a Texas county jail this week despite attempts by his attorneys to bypass the fingerprinting and mug shot process.

The former House majority leader was forced to step down from the post last month when he was indicted by a Texas grand jury. DeLay initially was charged with conspiracy to violate the election code and days later was indicted on charges of money laundering and conspiracy to launder money in an alleged illegal scheme to funnel corporate money to Republican Texas legislative candidates.

DeLay's arraignment is set for Friday before state district Judge Bob Perkins in Travis County.

"Perkins believes that if God was charged with a felony, he would have to go through the booking process, too," said D'Ann Underwood, court coordinator for the judge.

Before Friday, DeLay, a Republican from Sugar Land, will likely spend about an hour being fingerprinted and photographed, she said. He'll also be required to state his attorneys for the record.

Travis County allows some defendants to do a "walkthrough" booking process, in which the defendant is photographed and fingerprinted. But DeLay's bond amount would be preset so he could immediately pay it and avoid a stay in jail.

DeLay also could waive going before a magistrate to have his rights and charges read to him.

At Friday's court appearance, Perkins has the discretion to rule on motions to dismiss the charges, as requested by defense attorneys, but may elect to do so at a later date. The hearing will likely take less than 20 minutes, Underwood said.

This whole thing is so stupid. Sounds more like than the USSR than the U.S. Can't Earle & Perkins be stopped? (Sounds like a whiskey brand)

It sounds like this Judge doesn't take his duties too seriously. Not good for DeLay.

Sounds like Judge Kerry, er, Perkins, should be asked whether he can be objective. One question I would have is how the case came to be assigned to him.

Great. Just great. Guess the judicial/legal system's loaded, just like the Liberals planned. They're gonna litigate themselves into power, 'cause that's the ONLY way they'd get it.

Well, a Grand Jury indicted Delay. If Earle and Perkins did something illegal or inappropriate to get that indictment, then they need to be held accountable. However, there's no reason Delay should be given special treatment.

If Perkins can be trusted to conduct a fair trial, DeLay and his attorney won't leave much of Ronnie Earle for the rats to consume.

The info is that these charges already stink so badly that even limburger cheese is covering its nose from the stench!!!

I agree. No one who hasn't committed a violent offense or been arrested should be booked until convicted. There's no point in it.

But .. how can they do that .. the Earle cabal has already admitted they don't have ANY EVIDENCE FOR THE CHARGES THEY BROUGHT AGAINST DeLAY.

Without that evidence, the whole case should be thrown out - the charges should be dropped (as unprovable)!

Earle filed the case under FALSE PRETENSES. He's wasted the Grand Jury's time and the court's time. He is the one who should be booked - not DeLay.

Is this just more of the left spouting what they want to happen, instead of what is going to happen ..??

Remember, these were the same people who had Rove tried and convicted in the Pflame case - and now it appears Miller says she can't remember who gave her the information.

These lefties are just salivating to get something on this administration - they don't care what it is.

I wonder if there is a federal question here, one that could be heard in a less corrupt federal court. What we have here is an attempt by a state hack to interfere with the duties of an elected federal official through false and fraudulent charges. If a racist local sherriff arrests blacks on phony charges, you can get that into federal court pretty damn quick. How about a socialist trying to arrest conservatives for phony crimes?
