As recently as October 1, 2005 the plea for the Supreme Court to reinstate the Partial Birth Abortion Act is still being made. The ban on partial abortions would prevent the fetus (usually in its second or third trimester) from being delivered and then executed.
The ban was officially signed into law by President Bush in 2003. Recent upheaval about the reinstitution of the ban has resulted from many loopholes in the abortion process. According to Susan B. Anthony List.com, one example of an abortion violation occurred in the state of Minnesota during 2002. The following case was performed only one year prior to the Presidents approval for the Partial Birth Abortion Ban.
SBA-List.com tells that Planned Parenthood failed to inform the parents of a 17 year old girl that she was planning to receive an abortion, blatantly ignoring Minnesota state law. The dispute arises because Planned Parenthood claims they considered her an adult responsible for making her own decisions. Planned Parenthood justified their actions due to the fact that the teenager was merely a couple of weeks away from her eighteenth birthday.
The case now is Planned Parenthood v. the parents of this teenager. Many pro-life organizations and supporters are outraged by Planned Parenthoods actions in this particular case. This raises the question, is Planned Parenthood allowing underage teens to receive abortions more frequently. Another factor taken into consideration is do the parents of teenagers have the right to know and therefore influence the decision of their pregnant child?
Parental notification cases may reveal the need for stricter abortion laws such as the Partial Birth Abortion Ban or even improved Planned Parenthood notifications. Now it is the decision of the Supreme Court to determine if a woman is constitutionally guaranteed an unrestricted right to privacy.
determine if a woman is constitutionally guaranteed an unrestricted right to privacy.
A teenager is a woman now? What's her age? Can she buy a beer? Vote? Get away with murder?
A step in the right direction.
Now how about restoring Constitutional Rule of Law.
