Gun accidentally fires, kills 19-year-old woman (Louisiana)

Three roommates were comparing their handguns in the drive-through of a fast-food restaurant Tuesday when one of the pistols accidentally discharged, killing a woman in the front seat. Police identified the victim as Teaira Richard, 19, 10769 Alco St., Apt. 3.

Nicole Latrise Daniels, 20, who listed the same address as Richard, was booked into Parish Prison on one count of negligent homicide. Bond was set at $40,000.

The incident happened about 3:30 p.m. at the Popeyes at 10706 Florida St.

Daniels was in the back seat looking at a pistol one of the other two roommates had just bought, police spokesman Cpl. L'Jean McKneely said. Another girl handed Daniels a second gun, and as she was looking at both of them, one accidentally discharged.

Richard, who sat in the front passenger seat, was struck in the upper back, McKneely said.

The third roommate, whom McKneely refused to identify, drove Richard to Earl K. Long Medical Center, where she was pronounced dead.

An automatic weapon does not chamber the first round in the clip until you manually retract the bolt. You can put a full clip in and pull the trigger all you want, nothing will happen. The thing that makes it automatic is that after you pull the trigger on the first round, subsequent rounds are automatically chambered. A fully automatic weapon continues to fire as long a you hold the trigger, a semi- just chambers a round.

Another danger is that once a round is chambered, removing the clip leaves the round in the chamber. You need to retract the bolt to remove it.

"It's a good thing I keep my guns locked in a steel safe. They're always accidentally firing on their own. Last night they went through seven boxes of ammunition. It sounded like a war zone in my closet. I just hope they don't figure out how to go fully automatic."

I do the same thing. Always afraid that the guns will get together with my stupid SUV and go out and do drive-bys....

I would wager a significant sum that these women had no training, and were carrying the pistols illegally under Louisiana law.

Better hold your money. Unless the weapons were being carried concealed, or the persons possesing the guns were convicted felons, what they were doing was likely perfectly legal under Lousiana Law.

LA Constitutional provision"

"The right of each citizen to keep and bear arms shall not be abridged, but this provision shall not prevent the passage of laws to prohibit the carrying of weapons concealed on the person." Article 1, Section 11.

From the NRA ILA site's LA page:

No state permit is required to possess a rifle, shotgun, or a handgun. It is illegal for any person who is a national of a country with whom the United States is at war to own, possess, have custody, or use any firearm. It is unlawful for anyone who has been convicted of certain crimes of violence to possess a firearm for a period of ten years from the date of completion of the sentence, probation, parole or suspension of sentence. It is unlawful for any person under seventeen to possess a handgun on his person, but this does not apply to any person under seventeen who is attending a hunter`s safety or firearms safety course; engaging in practice in the use of a firearm or target shooting at an established range; hunting or trapping pursuant to a valid license; or traveling to or from one of the above activities.

Let's see. How many concealed carry permits were in the car?

Don't need no stinking permit to posses and carry unconcealed in Louisiana. Or Texas either, if one stipulates that the "carry" is in a vehicle, and is concealed but not on the person. (IOW, it could be under the seat,in the glove box or center console, or under a newspaper on the seat).

If they had just bought them, why were they already loaded?

Maybe because they bought some ammunition too, yah think?

They may have been no goodniks, but we really can't tell from the story. Y'all are jumping to conclusions based I suspect on the names their momma's gave the two named ones. They all appear to be young ladies, at least the two who are named do. They may, just may, have wanted the guns for protection. But at least one of them broke at least two and probably three of the commandments of safe gun handling. Probably because their parents never taught them those in the first place.

I wander if their fathers ever took them to a range and demonstrated a level of trust to their young boys.

I believe Nichole and Teaira are girls names. Not that it matters. I know I taught my girls, now 30 and 25, safe gun handling. Both of 'em favored handguns too. BTW, the older one now has a JD (and a new baby!) the other is a PhD candidate.

What's the fun in that?

You gotta do it safely, but showing off your weapons is one the enjoyable parts of the gun culture.

A girl is still dead. My bright, beautiful cousin was killed by a gun that accidentally went off. Who cares whose to blame...she's still dead.

Who is to blame is not so important, unless it was a deliberate act. What behavior is to blame is vitally important. If you don't know what went wrong, you can't keep it from happening again.

Im not sure of the age requirements for possessing a handgun in Louisiana, but it does not mention anybody there being over 21

According to the NRA ILA website, it's 17 in LA. Of course federal law says you have to be 21 to purchase a handgun from a federally licensed dealer, but there are other lawful ways to purchase, or be given, a handgun.

Thanks for the information. I figured that the pistols were concealed, at some time, but I can't prove it.

Nice post on LA law. I wonder if the NOLA police abide by it.

that's why the safe is so important. Allows one to get sleep at night without the worry of the guns going on a midnight raid.

I am not coming to the defense of stupidity. Further I no that guns do not shoot themselves (suicidle or otherwise). That said, I was 13 and pheasant hunting with my father. We were loading our shotguns in the field and his 20ga mossberg went off after he chambered and round and went to slide in the 6th shell. Scared the poooop out of us to say the least. He had the gun pointed in a safe direction. We spent an hour trying to figure out how it happened. Interestingly enough, we ruled "magic" out right away.
