The long he waits, the harder it will be, but he MUST pull Miers and nominate a solid conservative candidate.
While I would prefer to see Bush pull Miers, her inevitable defeat on the Senate floor would suffice.
The way she will be defeated will effectively swap the Democrats' ideological litmus tests with one of competence and qualifications. This would actually put Bush in a better position than he is in now to nominate an exceptionally qualified conservative jurist such as the ones typically discussed here.

Sorry. The Left is all about Roe.
Time is on the Dems side. They would like nothing better than to trash Miers (along with Bush and Republicans in general) all day long from Nov 7 into December, dump her, and make Bush start from scratch. In the meantime, the SCOTUS is reviewing cases with O'Conner voting instead of a conservative judge.

There is the potential for baggage besides the recuse/not recuse outcome. Like DeLay and the bogus prosecution, the DEMs can bring the issue up just to whip public opinion. They did with the Scalia/Cheney duck hunting trip.

Yes, and the cat is out of the bag on Miers.
The Democrats will not have to resort to defeating her over ideology, though, since she is ripe with ample rudimentary biographical flaws.

Democrats have been trashing Republicans non-stop since at least 1860.
The 2006 elections aren't for another year. The closer we can get an bloody fight on ideological grounds over a competent, qualified nominee, the better for Republican fortunes in the election.
If Bush could put off nominating a superb replacement nominee for Miers until summer, then that would be perfection.
I've seen a few people mention this pending partial-birth abortion case after Thanksgiving. I'm sorry, but one vote in one case is not worth a 30 year mistake on the Supreme Court. That's a trade of potentially 3,000 cases for one.
I'd rather get those 3,000 right than rush in hastily for the sake of that one.

CAS is the "Clinton Administration Scandals" mailing list. It's a group of people that got together several years ago to share news articles and commentary regarding the Scandal-a-day Clintons via email. Don't remember exactly when or how I got on it, but it was probably back during the old Prodigy days or possibly about the time FR was started.

I'm sure that Pat Leahy would agree with this.
Although it is better to overestimate than to underestimate your opponent, the position of the Left regarding matters such as the Constitution being a "living document," consideration of precedents established by foreign courts, and their obsession with Roe are sophomoric at best and do not require that we nominate Socrates to the bench in order to refute them. All we need to improve the bench is someone who adheres to an Originalist philosophy.
