Luttig helped Clarence Thomas during his nomination. At the time of the nomination Luttig had been confirmed by the senate for the 4th circuit and stayed on to help thomas until he was seated on the bench. The dems have said they would fillabuster Luttig.
I don't dispute what you are saying. But, this sounds more like a pretext for a filibuster than the real reason.

Yeah I just saw that. Silly me. I still stand by the opinion that more would be gained for conservatism and President Bush by nominating a well qualifed conservative minority judge. Does anyone really want a Democratic President to get the title of "First President to nominate a Hispanic or Asian to SCOTUS"? I'm still surprised that Clinton did get more gried for nominating two white people.

Judge Alito will be grudgingly confirmable to many Democrats once they look at his record, Why would that be, vis a vis Luttig?

I'm sorry, I just can't get all worked up about earning brownie points with the left by having a Republican President earn the coveted title of "First President to nominate a Hispanic or Asian to SCOTUS". Heres a tip. They hate and vilify him anyways.
Not to mention that Conservatives should not give a rats posterior about gaining such PC diversity BS accolades. The only question that matters should be, who's the best person for the job. Period.

It's possible.
But Miers was floated the weekend before. The problem is that no one took her seriously as a nomination.
The suspicion, and I think with some merit, is that the W.H. is leaking a few names to test the base reaction to avoid another furor like we had with Miers. Alito seems to keep popping up everywhere, as does Luttig and to lesser degree Williams & Sykes.

Luttig is a movement conservative that is the real reason they would fillabuster him. Luttig would be the new third vote with Scalia and Thomas. Roberts and Alito are both incrementalists.

Besides his Federalist and Pro-life bona fides, I think that this is the ruling that has received a high level of publicity:
"Stayed a district court's judgment invalidating Virginia's ban of so-called partial-birth abortion on the theory that the law was constitutional. The Supreme Court later disagreed by a vote of 5-4. (Richmond Medical Center for Women v. Gilmore, 2000)"

I could care less what the New York Times has to say. I do not view them as a serious newspaper.
What gives the story credibility is Tom Goldstein's opinion. He is an insider that specializes in Supreme Court litigation.

Our local paper is owned by the NYT, and I have told advertisers that
I would not purchase merchandise in their stores because of their choice. I know
that sounds foolish, but thats how I let them know what "this part of the public"
thinks about the NYT's.

Isn't Alito Roman Catholic? If so, try to imagine the fall out were FIVE Catholic MALES to overturn abortion on demand. Then we can look forward to Dianne Feinstein questioning his loyalty to the Pope. Of course, if anyone questioned if DiFi was loyal to Israel, she would scream anti Semitism.
