OAKLAND, Calif. — Revelli Tire ( search) has been a family-owned business in Oakland, Calif., for 56 years. But if action by the city council remains on course, the tire store will have to find a new home or go the way of the dinosaur.

In July, using the power of eminent domain, the Oakland City Council evicted John Revelli from his store and locked the doors. The council's argument: One landowner should not impede the progress of a city on the move.

"I am being forced to give up and give away all I have worked for all these years," Revelli told FOX News.

The city also used its power of eminent domain to obtain the parcel for a commercial retailer, Sears, which wants to put in its tire store.

New twist. Oakland wants this guy's tire store so that they can sell the land to Sears who wants to put their own tire store in. If you can't beat them in the open market, why just have the city TAKE their land and put them out of business!

City councils using ED should be arrested for theft.

I believe Sears & Roebuck predated Bolshevism.

Oakland had better hurry. This new bill will put a crimp in the "Eminent Domain" for profit game.

I live in a little dink town in WA and they are already EDing a landowner because he won't see them a strip of his land so they can put in a huge subdivision. They need his land for sewer hook up. It is absolutely WRONG!

In my city they want to take about 15 homes and 20 business and a church and give the land to developer. They want to build 300 condos and a couple restraunts. Time for another boston tea party I say.

All I can say is that no-one will ever enjoy a profit on my land by way of an eminent domain suit.

Not the politicians that ram it through.

Not the Board or CEO of the company behind the politicians.

Additionally, before I walk away from it the last time, I'll render it unusable for as long as I'm physically able to accomplish.

Draw the line, and then stand behind it. It's the only way these cowards will get the message.
