Recent Same-Sex Marriage Ban Texas Vote Helps DeLay’s Change of Venue Motion

This one slipped under the liberal MSM’s radar, so I wanted to address this significant event and it’s upshot for Tom DeLay’s Motion for a Change of Venue, i.e. moving his criminal case out of Travis County, a.k.a. “The People’s Republic of Austin.”

On November 8, 2005, Texas voters soundly approved a constitutional amendment, (Proposition 2) by a 3 to 1 margin, to ban same-sex marriage, becoming the 19th State to constitutionally do so.

Travis County (Austin) was the only County of 254 Texas Counties that voted against the Same-Sex Marriage Ban (SSMB) by 40% / 60%. The next closest vote to Travis County was Hays County which voted FOR Prop. 2, 58% / 32%. (Thanks DrewsDad for the next county data). As delineated, in the detailed attachment below, many Travis County Officials were against the SSMB and donated to an anti-SSMB local Austin organization. These Travis County Officials included Judges.

Recently, there has been significant press stimulated by the Dems-Soros~Shadow Party-Earle Mob that Tom DeLay could in fact receive a fair trial in Austin. Dick DeGuerin’s recent comment to this was, “Any fool who thinks that Tom DeLay can get a fair trial in Travis County, I'll arm-wrestle 'em."

In true form, as further delineated in the below attachment, the Dems-SSP-Earle Mob’s hyperbole is without merit and the Travis County vote against the SSMB is prima facia evidence that DeLay, and his indicted associates, could NOT get a fair trial in Travis County. Travis County is not only heavily Democrats, it’s heavily liberal Democrats, that are totally out of step with the general population of the State of Texas, DeLay's District 22 constituents, Texas’s large number of conservative Democrats, and neighboring States that have voted on a Constitutional SSMB.

There are several additional adjunctive factors to consider in this matter, and Tom DeLay’s support for his Motion for Change of Venue, as it related to this specific issue:

1.) - Tom DeLay is a very strong advocate for banning same-sex marriage on a Federal Constitutional Level

09.29.04, AP - Washington DC: (Annotated) Tom DeLay led the House's Bill banning same-sex marriage that was defeated today, with several leading GOP House Representatives refusing to join him. The vote was 227-186, far short of the two-thirds needed for a Constitutional amendment approval. DeLay said the need for congressional action was "forced upon us by activist judges trying to legislate from the bench." He noted that under 1996 legislation passed by Congress and signed by President Clinton, marriage is defined as between a man of a woman. "One would think this would be the end of the story. But it is not," DeLay said. The law is "under an incessant and coordinated attack in the federal courts," where he said judges feel a greater "responsibility to their own political ideology than the Constitution." Representative DeLay’s lead to pass the Bill was supported by Rep. Roscoe Bartlett, R-Md who said "God created Adam and Eve, He didn't create Adam and Steve." “This bill is designed to protect an institution as old as civilization itself.”

Tom DeLay has received extremely critical local Austin press, and Dems-SSP National press, because of his conservative Christian views and lead support for a Federal SSMB and a Texas SSMB.

2.) - Texas Marriage Alliance (TMA) - The lead proponent of Texas Proposition 2 SSMB was TMA, whose key spokesperson was conservative Christian Texas Governor Rick Perry. TMA was set-up, and consulted, by DeLay’s criminally indicted TRMPAC associates, John Colyandro and Jim Ellis via their firm PRI Strategy Management (PRIsm), which is a full-service governmental and public affairs consulting firm with offices in Washington DC and Austin.

Like DeLay, Colyandro and Ellis were criminally indicted by Ronnie Earle and their cases were being heard by Judge Perkins. Judge Perkins was removed (recused) from presiding over DeLay’s case, and he also voluntarily removed himself from DeLay’s associates case, post-forced recusal by Judge C.W. Duncan.

The Dems-Soros~Shadow Party Mob (and George Soros “dear friends and allies” The Communist Party–USA and CP.USA - Texas) were heavily against the Texas SSMB. Additionally, the Dems-SSP numerous anti-DeLay organizations and enterprises, along with CP.USA-Texas, used this opportunity to publicly bash Tom DeLay and Governor Perry because DeLay’s criminally indicted associates were involved in TMA. Obviously, these DeLay and associates bashing fools believe this great country should be governed by Roman and Napoleonic law, which presumes a person accused of a crime to be guilty until proven innocent. These ignorant fools would be better served by moving to Mexico as this is the basis of their judicial system.

- - Texas Prop 2 Data: Blacks and Hispanics who traditionally vote Democratic strongly backed the state's gay marriage ban at the ballot box, sometimes outpolling Republicans, per analysts. Big approval on the Texas/Mexico border. Along the heavily Democratic, Hispanic and economically distressed border with Mexico, it passed by 81 percent in Hidalgo County, 75 percent in Webb County and 86 percent in Jim Hogg County.

- - Harris County (Houston) favored the SSMB amendment by 72 percent overall, but that proved slightly higher in the inner city black neighborhoods, several analysts noted. Houston-based "Vote Against the Amendment" raised and spent nearly $160,000, with the biggest contribution, $100,000, coming from Denver software entrepreneur Tim Gill.

- - Southern States SSMB constitutional amendments have tended to pass by large margins for example - Mississippi passed by 86%, Louisiana by 78%, Oklahoma by 76%, Texas by 76%, and Arkansas by 75%. The most liberal State in the Union, Oregon passed the constitutional SSMB amendment, but by only 56 percent.

- - Travis County was the only County of 254 Texas Counties that voted against the Same Sex Marriage Ban. The next closest vote to Travis County was Hays County which voted for Prop. 2 SSMB, 58% / 32%.

According to articles in the Austin American-Statesman (AAS), 22 Austin leaders were against the "Same-Sex Marriage Ban" which was always referred in error by the AAS as the "Gay Marriage Ban"

Many of the above Travis County Officials donated money to "No Nonsense in November" (NNN) (spin-off of No Nonsense in 2006), an Austin-based anti-SSMB amendment group led by former Travis County Rep. Glen Maxey, who is openly gay. NNN raised nearly $161,000 from late July through Sept. 29, spending nearly $86,000, according to its report filed with the Texas Ethics Commission. The group had nearly $75,000 on hand entering October. (No Nonsense in 2006, reported $13,155 in contributions in hand after spending nearly $26,000.)

1.) I'd bet a year's salary that Ronnie Earle was against the Same-Sex Texas Constitutional Marriage Ban.

2.) There is 23+ million people in Texas. Opponents to the gay marriage ban said it would affect about 43,000 same-sex couples in Texas. Question: Why is the State of Texas and its citizens expected to make an exception for less than 1/5 of 1% of the population, that will not get proper treatment for their disease? Hormone therapy has been proven highly effective in placing into remission homosexual tendencies, behavior, and associated neurological dysfunctions, particularly in males. Why doesn't society and lawmakers work to fix the problem, instead of creating laws that legitimize this very serious disease? I'm not passing judgment, only stating the well published medical facts on this matter, and I make these statements as a moderate Republican.

However, State Constitutional amendments were passed to inoculate States from rulings such as the November 2003 decision by the Massachusetts Supreme Judicial Court that state equal-protection guarantees made it illegal to deny marriage to gays and lesbians.

The homosexual monogamy issue is a stealth issue for the leftist scum and the RINOs. As with the Supreme Court wrangling, they will use abortion as a smokescreen to hide this. I think they are doing the same here with Tom DeLay.

The left wants to use the courts to force the unpopular homosexual agenda upon us like they did with abortion.

Thanks for the acknowledgement, but the Hays County result should be 58-42%. I either typo'd the number or had math malfunction when I posted it originally. It should also be noted that Hays County borders Travis to the south, so there was probably some Austin Metro influence.

Thanks, I should have caught that math error. Concur on the Austin effect on Hays County. To be honest, until this SSMB vote, I didn't realize Austin/Travis County was THAT liberal. Geee!

Was dead tired when I drafted this piece. Still not back in my residence from damage by Hurricane Wilma. Hope the darn hurricanes go some place else other than Florida next year. Two straight years of major Florida hurricanes has become real old.

Guess I shouldn’t let the cat out of the bag but.....after Tom DeLay beats Ronnie Earle like a borrowed mule, the Texas legislature is going to pass another constitutional amendment to give Travis County back to Mexico, except for the land around Steve Ray Vaughan's Memorial Statue in Zilker Metropolitan Park, Austin.

This ban was approved by 76% of Texas voters, with Texas becoming the 19th State to approve the ban. All 254 Texas counties approved the ban except Travis County (Austin), where Christian conservative Tom DeLay, and his two associates, criminal trials are being heard as of 11/15/05. MoveOn.org, CPUSA-Texas, and many other George Soros~Shadow Party organizations heavily bashed Tom DeLay, his two indicted associates, and Texas Govenor Rick Perry for their public support of the Texas Constitutional Ban against Same-Sex Marriage. CPUSA and their Texas chapter's Tom DeLay bashing articles and rhetoric are very similar, like the same person was the source.

I don't know if the Travis County outcome was a result of Democrats voting in block, or highly energized typical non-voters, or perhaps newly registered voters. I read somewhere that there were 47,000 new residents to help influence the election. I'll have to check with the election analysis guru I know.

May you get everything restored and may the hurricanes avoid you. At least Florida seems to have the hurricane preparation logistics down.
