Schwarzenegger Mulls Clemency for Williams [Tookie]

San Francisco -- Gov. Arnold Schwarzenegger said Friday that he would consider granting clemency to Crips co-founder and convicted murderer Stanley Tookie Williams.

After a private hearing with Williams' lawyers at his Sacramento office, Schwarzenegger said he would meet again on Dec. 8 with the lawyers, Los Angeles County prosecutors and others involved.

As governor, he has the authority to commute a death sentence to life without parole. He is not legally obligated to hold a public or private hearing. Schwarzenegger decides clemency requests on a "case-by-case basis," . . .

Isn't leaving convicts on death row for an indefinite number of years cruel and unusual punishment by any rational standard?

Yeah, it is, and I'm all for it. Think about it--if you knew the day, hour and minute you were going to die, where it was going to happen, how it was going to happen, who was going to be there--it'd drive a normal man crazy as the clock and calendar clicked you closer every minute.

Tookie should fry.

but given that Arnold's ballot initiatives failed because of lack of conservative voter support - frankly, as a purely political matter - I don't know that he owes the right anything on this issue politically.

It doesn't matter whether or not he is remorseful or rehabilitated. It is G-D's job to forgive him, our is to send him to G-D. Kill him now.

Arnold HAS to say that he will 'consider' the case. To do otherwise would be a PR disaster.

Tookie is going to die. Arnold is just doing his job.

"Stanley "Tookie" Williams (born December 29, 1953) was the founder, along with Raymond Washington, of the Crips, one of the most widely-known and notorious street gangs."

"He grew up in impoverished South Central Los Angeles where he made a name for himself for being a fighter and a "general" on the streets of the West Side of South Central. He was also known for his bodybuilding, which according to Williams, once earned the praise of Arnold Schwarzenegger himself when the two met in the late 1970s."

There's no clause in the Constitution that allows for forced revocation of membership.

You might be thinking of Article 4, Section 3. "New States may be admitted by the Congress into this Union; but no new States shall be formed or erected within the Jurisdiction of any other State; nor any State be formed by the Junction of two or more States, or parts of States, without the Consent of the Legislatures of the States concerned as well as of the Congress."

I think, that because of the constitutional prohibition against cruel and unusual punishment a law should be passed calling for execution in a timely and predictible manner.

And no more of this lethal injection non-sense. It's supposed to be a punishment. We're not putting an unwanted dog down; we're executing a criminal! Public hanging is traditional and educational. This Tookie should have been hanged by the county of Los Angeles many years ago.

You knew he would cave? Has he caved? He's merely listening to the attorneys which is SOP before the execution.

Let's see, you never liked Arnold anyway. I can't tell you how he'll vote ... but he had better not grant clemency or his political aspirations will be over immediately.
