Do your own research. But it doesn't take a rocket scientist - or even a sentient being - to read the Gonzalez memo definitions and know that they are at odds with the definitions in the treaty to which the US is a party - or even to see that they are inconsistent with the 5th and 8th Amendments which the Senate expressly stated would be a measuring stick for compliance with the treaty.
Simply stated, if it would violate the 8th to do it to an American, it violates the treaty to do it to a foreign citizen. EOS. If you don't like it, get the law changed. But, based on recent doings in the Senate, methinks you don't have the votes. Seems most folks still cling to the idea that we must hold ourselves to a higher standard. Sad that you want us to behave like the Egyptians or something.

If you believe that permitting torture will prevent the first or cause the second (at least if you are talking about speaking the truth), then you are remarkably juvenile. If you think that torture is the only way to prevent the first and obtain the second, you are also lacking in any critical thinking skills.
Our military brass doesn't want us to torture. I'll stand in their company over yours any day.

Still need a trial. And for that you need for someone to have broken the law. I'm no lawyer but I believe there's an EO that says we can put the bag on suspects like Masri. You obviously don't like it, but that doesn't make it illegal.

Torture is already illegal. This McLame legislation simply adds constraints beyond that which further hamstring our men and women in uniform endangering them and the US.
If it were up to me, I wouldn't even ban real torture for islamo-fascists that kill and main innocent people including women and children. Even killing is too good for them IMO.
