Getting Over Alito
TIME ^ | 01/15/06 | MASSIMO CALABRESI

Posted Sunday, Jan. 15, 2006

The Samuel Alito hearings are over--but some Democrats were left wanting more. Things went badly from the start: few Americans watched, and those who did saw Alito and his supporters calmly parrying suggestions that as a Supreme Court Justice, he would threaten America's balance of power, civil liberties and citizens' right to privacy.

"He's rope-a-doping them," said a frustrated Democratic aide. Any points the Dems scored were erased by Alito's wife Martha-Ann, who broke down in tears as the questioning of her husband grew increasingly personal. Her emotional reaction sealed her husband's victory--but the Dems had other reasons to fight on.

Although Senate minority leader Harry Reid and other moderate Democrats would like to refocus on the more politically profitable work of bashing President Bush and the Republicans on Iraq and corruption, liberals including Ted Kennedy hope to delay the Judiciary Committee vote on Alito. That would give advocacy groups time to target Alito via TV ads, petitions and phone banks. "They want some additional time to beat the drums in opposition," says an aide.

Defeating Alito seems unlikely. The best Dems can hope to do, the aide says, is highlight wedge issues that can be used against weak Republicans in November. Still, the liberal lobby is talking tough. "We've just begun to fight," says Ralph Neas of People for the American Way.

If anything, such words encourage G.O.P.ers. Emboldened by the expectation that Alito's victory is secure, they are happy to drag out the debate an extra week. Doing so may produce a bonus by moving a vote confirming Alito closer to the State of the Union address on Jan. 31, allowing the President to showcase his win.

The wedge issues the liberals want to talk about are coincidentally 100% LOSERS for them. It is great for conservatives that these DUmmies don't seem to realize that.

* Abortion is unpopular with Americans
* Gay Marriage is unpopular with Americans
* Keilo decision is unpopular with Americans
* Civil Rights issues are LONG settled and are total Yawners with Americans

What else they have left? A disabled plaintiff filing a suit against 3M??

I don't think abortion is unpopular with Americans. A majority still want it legal. Granted, a majority would limit 3rd term abortions and more and more are opposing it, but abortion is not the peg I'd hang my hat on for saying America was on my side. Maybe leaning my way, but we're not there... yet.

I agree with everything else you've said. Keilo is enormously unpopular. Same thing with gay "marriage." Civil rights? I mostly just roll my eyes at these, as there's generally a shrill voice and thin skin on the other side of the squeals.

who do the Dems think is stupid?

Anyone who is not a dem, including, but not limited to, some of their own fellow dems.

Who nominated Alito?

Some guy who went to yale for his degree and got his MBA at harvard.

Who is giving the State of the Union speech?

The guy from Texas who got higher grades in college then the junior senator from Mass.

I get it now, when you say why do the stupid guys win, you mean "moral victories", yea, the stupid guys got those, good thing they didn't get any real victories.

Its always easy to out smart the stupid folks, just make sure they feel smart and think they are smart, and everything works out okay.

I remember laughing back in 2000 when the "smart guy" was a guy who passed college, then flunked out of divinity school and dropped out of law school....and lol, people thought he was smart.

Abortion is one of the weird issues.

Poll after poll say Americans want it to be kept legal, poll after poll shows that Americans have never met a restriction on abortion they didn't like.

FWIW, the polls are kind of screwy, some polls allow folks who want abortion banned with exceptions for rape, incest and threat to a mothers life to be considered in the "want abortion legal" camp, while others list them as pro-life, its why the polls are always all over the place on the issue.

A strong majority do hate abortion on demand though, and that can cost dem votes.

You are right about a majority of Americans wanting to keep it legal, but that is not the same thing as them supporting it. It is indeed unpopular. When it comes passing laws in favor of it, I expect those laws to be very restrictive, even in liberal states.

Ive lost a friendship when a guy started telling me Bush was stupid...after 8 years of hearing how smart Clinton was...I couldnt handle it. Clinton is happy hearing himself talk...Bush wants to use the time he has to get something done.He has the instincts of a cat.

The rats have been reduced to whining that Alito didn't answer their questions. This is a joke to anyone who watched the hearings or read the news accounts that explained how little time the rats spent asking questions as opposed to how much time they wasted making speeches.

I am pretty certain the rats will filibuster rather than face the wrath of their base. I do not trust McCain's gang of 14 RINOs and DINOs to abide by their agreement to not filibuster. I hope I am wrong as I think Alito will be a fantastic SCOTUS.
