In my opinion, both sides asked the judge to rule on the scientific validity of intelligent design. He did exactly that.

The intelligent design defenders erred in asking the judge to rule that ID is valid science. This isn't the real problem.

The REAL problem is that government schools can NOT ever be neutral politically, culturally or moral and ethically ( that means religion). Government schools can NOT be neutral in content or consequences.

This means that government schools establish and uphold the political, cultural, and moral and ethical ( religion) worldviews of some while at the same time undermining those of others.

The solution of course is complete separation of SCHOOL and state.

By the way, I personally support evolution.

And on the other side of weather vane:

Most states, even prior to the Revolution found that a some level of basic education was a civic necessity, and that taxes laid on the public to support such basic education were proper. That is why, iirc, the Colonies prior to the Revolution, from the time of Great Awakening through the Constitutional Ratifications were the most literate of societies, ecepting perhaps Israel before the diaspora.

Not only the basics of reading, writing and arithmetic were taught, but basic morals and religion too. On the public dollar. As the result showed, not only was such a system a good thing, it was a excellent thing beyond any other in human history.

So why is a rational man of modern times such as you may be presumed to be so willing to chuck the concept?

And BTW, your "btw" is no such btw, that btw is to the core of all these discussions. So what do you mean by "evolution"? It is NOT a well-defined term and means as much as "love" did back when Coca-Cola marketed that "Coke is Love!"
