The administration decided to put him into criminal justice system, NOT Chief Justice Roberts.
So in the criminal justice system, the defendant should and will be treated as a criminal defendant, NOT as an enemy combatant.
Blame the administration, not the justice.
At the risk of putting words in the mouth of PresidentFelon, I would call for an expeditious trial of Padilla and others of his kind, before a military tribunal as an enemy combatant out of uniform (for those that do not seem to realize...that's an espionage agent), conviction and execution before a firing squad.
It matters damn little to me if the guy trying to blow up innocent US citizens is himself a US citizen, an arab, albaniac, chechyn or whatever the hell else.
The administration approach has been very indecisive and weak kneed. There is no such thing as rehabilitation of islamofascists. The priority should be to rid the world of them, not "warehouse" them.

What "basic rights" have you lost? Planning on an insurrection or terrorist action anytime soon? If so then you are provbably right. But if you don't plan to blow anything up I think you, and every American not suspected of terrorist activity, will be all right.
The Justice Department is trying to protect us. I'm not about to shoot at them while they are attempting to protect me and my children. When I hear a single case where an average American citizen, one not connected to terrorists, is unfairly imprisoned or held without trial, I will be right beside you. Until then I want the Justice Dept and the rest of the government to work as hard as they can to keep terrorists and their facillitators off the street.
