US lesbian denied fertility treatment sues Catholic docs

A woman whose doctors refused her infertility treatment because she is a lesbian has sued before California's Supreme Court, her attorney said.

"Our client's doctors' behavior goes against established medical ethics and violates California civil rights law," said Lambda Legal attorney Jennifer Pizer in a statement announcing the suit was filed on Monday.

"The doctors claim a right not to comply with California's civil rights law because they are fundamentalist Christians and they object to treating a lesbian patient the same way they treat other patients," the group said in a statement.

An appeals court overturned a trial court decision that Guadalupe Benitez was denied infertility treatment in violation of California law.

"Doctors are supposed to treat their patients, not make religious judgments about them," Benitez said in a statement.

"I trusted my doctors and then they humiliated my family and me by refusing to perform the insemination procedure after they'd been treating me and promising it to me for nearly a year," she said.

So where does it end? Talk about a slippery slope. Just waiting for the doctor who refuses to treat a Muslim. Or a doctor who refuses basic treatment to a homosexual. And so on... Kinda ironic, too, considering this Catholic doctor is, in a sense, playing God with fertility.

This is all getting ridiculous.

the Catholic doctor is attempting to NOT violate the tenets of his religious faith by NOT administering artificial insemination to a woman who cannot conceive naturally because her partner is ANOTHER FEMALE. God dealt with this situation by making it impossible for a pair of females to NATURALLY produce a child. so GOD is playing GOD in this case.

can you truly not see the difference between treating a muslim or homosexual for basic care and administering a procedure which involves the artificial creation of life, in contravention of one's particular religious beliefs?

I don't see this as a slippery slope at all. This had nothing to do with "basic" or "life-saving" medical care. I doubt the doctors would have denied that at all. Furthermore, infertility can be caused by legit medical problems that can be treated. Her desire to be inseminated is only because she doesn't want to have sex with a man to get pregnant.

I agree with the other posters on this thread. Sounds like she kept her lesbo identity hidden. Gee, I don't even think they would have been treating her for infertility if they knew she WASN'T even having sex with a MAN.

You are deceived by propaganda.

The article states that the doctors refused to artificially inseminate her.

Catholics do not believe in artificial insemination and will not perform this procedure on anyone, whether they are a sexual deviant or not.

Nor will they perform an abortion or a vasectomy or a tubal ligation or a sex-change operation.

This has nothing to do with refusing anyone basic, life-saving treatment - it has to do with refusing to perform immoral elective procedures no matter the religion, race or personal conduct of the individual requesting them.

the doctor is not "playing God."

Every developmentally human being has a reproductive faculty which may be healthy or which may be injured or diseased.

A doctor's job - to treat injuries or diseases - is not "playing God."

The Catholic reproductive doctor seeks to treat reproductive injuries or diseases in order to restore the ability of the patient to naturally procreate.

Ahhh, yes. I'm sure much greater than the humiliation of having daughter who is a lesbian.

Well, then, a lot of good Republicans (Sonny Bono, Dick Cheney) have had to suffer. I've come to the conclusion that homosexuality is not a choice but a condition (much the same as some persons predisposed to alcoholism or bipolar affliction). That doesn't mean I condone the homosexual act but I certainly don't condemn gays or lesbians for being the way they are...and I don't believe that parents of gays or lesbians (one particular parent is a close friend and the other a relative of mine and both are conservatives) do either.

Doctors, IMHO, should be true to their Hippocratic Oath and provide medical services to the patient rather than judging them (that's God's job).

Artificial insemination is NOT a necessary treatment. It is an elective procedure.

Amen to that! Conscientous objectors to war, are taken seriously, and if it is believed they are sincere, they are excused from "War"....the same folks that agree with "conscience" in that situation and others, would deny this Doctor the same right of conscience. The left really has no principals, they just make it up as they go along.

LOL! Refusing to inseminate someone violates the Hippocratic Oath?

You're unclear on the concept.

Patients, IMHO, should allow doctors to live by their consciences rather than hauling them before a judge for refusing to perform immoral elective procedures.

It's America - if you want a doctor with no morals, go find one and pay him to do your dirty work. A doctor is not a slave.

I'm glad to see a doctor that stands up for his beliefs. I'm positive she could have found another doctor who had no ethical or moral problem with performing the procedure on her.
