It's supposed to be an affirmitive defense, but lately they are charging you if you do and sometimes you get convicted.
You would think after getting busted several times over the years for skimming articles and posting somthing about them before I read them fully that I would be more careful but alas im not lol maybe they should split the difference and depor thim to sweden even if he claims hes not from there :-)
It might have been a crime in Ct if Jose didnt try to run away first or retreat into a different part of the house...

My thoughts as well. Assuming his story pans out, drop the idiotic murder charge and ship the guy back to Guatamala.
