Court Grants New Hearing In Case of Taped Phone Call (McDermott - Boehner case)

WASHINGTON IN BRIEF

A federal appeals court agreed to hear new arguments in a case involving an illegally taped telephone call leaked to reporters by Rep. Jim McDermott (D-Wash.).

In an announcement last evening, the U.S. Court of Appeals for the D.C. Circuit said all nine judges will hear McDermott's appeal of the case, which dates back nearly a decade. Arguments will be heard in September, the court said.

A three-judge panel of the appeals court ruled in March that McDermott violated federal law by turning over the recording of a 1996 call involving then-House Speaker Newt Gingrich (R-Ga.). That upheld a lower-court ruling that McDermott violated the rights of Rep. John A. Boehner (R-Ohio), who was heard on the call. Boehner was then a Gingrich lieutenant and is now House majority leader.

Oh no, there must be some mistake. DemocRATS can't violate the law because DemocRATS are not subject to the same laws./sarc

I hope McDermott spends the rest of his life living in a cardboard box, playing the spoons for quarters on the street. But what you wanna bet he never pays a dime?

Thanks for the explanation. I know they were caught dead to rights ... but I still do not trust the Court system ... it is packed with lefties.

But the appeals court agreed with a lower-court order that McDermott pay Boehner about $700,000 for leaking the taped conversation. The figure includes $60,000 in damages and more than $600,000 in legal costs.


I don't get it. what is the appeal about ?

He can't use his election money to pay this off, so he's looking to get the monetary amount lowered as much as possible.

He'll stay in office no matter what. Charles Manson could run as a democrat in his district and win. Its as liberal and liberal gets in that area of Seattle. "Baghdad" Jim McDermott already been annointed "Congressman for life" in Washington State.

I'm no lawyer, but the whole Circuit Court has decided to vacate decision that three of its members made in March. It's the last chance before SCOTUS.

I guess there had to be more to the judgement than money...but why affirm for damages if you you decide to take up the appeal ?

I'm just too darn lazy to do the research.
