When debt collectors go too far
Privacy Rights Clearinghouse ^ | August 24, 2004 | Brytani

Posted on 08/23/2006 12:35:53 PM PDT by Brytani

With all the recent news stories of debt collectors landing in prison or being taken out of business for illegal and strong arm tactics, I thought i'd share with my fellow Freepers a great resource to help if you ever have to deal with a scumbag debt collector.

http://www.privacyrights.org/fs/fs27-debtcoll.htm

This link has resources to use if dealing with collection agencies/collectors, your rights, links to the FTC, sample letters and more.

I hope this is helpful to some Freepers who've been hounded rightly or wrongly by this pretty much unregulated billion dollar a year industry.

Who is the scumbag, really? The non-payer of a legitimate debt, or the individual hired to collect it?

While we're doing this, the car is a Lexus. The lookup service is Lexis (actually LexisNexis.)

Check the thread title. One does not "go to far," unless "far" is a destination.

I didn't think about trying to get my state to help me, figuring they were out of Ca and Ca should handle it.

Thanks for the info, I'll give them a try as well.

Their name is Bay Area Credit the number they call me from is 408-392-4578 and it comes up on caller id as San Jose, CA.

Corporate Headquarters

50 Airport Parkway, Suite 100,
San Jose, California 95110
Phone: (866) 222-2097
(408) 392-4400
Fax: (408) 392-4520

Now, if I could only find some porn site to start spamming their fax machine, free, daily, I'd be happy.

My mother passed away two days before Christmas in 1989 .She was always a stickler for paying her bills.Being a private woman, not many of us children knew what was what. Then the collectors started coming. Some were dumb enough to think they could just start taking things! Not a good move!It was during the winter[Christmas],where they put your body on chill till the ground thawed. We hired a lawyer, who arranged to meet with the family to 'chop up the assets',so to speak. When the collectors showed up,the meeting place was a storage room for the bodies[o degrees]and the lawyer asked the bill collectors what is what questions they wanted my Mother to answer. They were all in shock,as they thought, they would be doing lunch, and so on.Needless to say,the bill collectors quit calling.

BUD HIBBS SAYS

Head Debt Collector:
Richard B. Hunter
Bud Says…
When Bay Area Credit Services Head Debt Collector Richard B. Hunter used the debt collectors slogan; ‘Your Bridge to Financial Recovery’ in his internet ad, did the people he was collecting for and from realize that bridge stretches all the way to INDIA?

When will cheapskate debt collectors like Richard B. Hunter realize that Americans do NOT want their personal information such as names, addresses, dates of birth, driver’s license numbers, credit card numbers, social security numbers, employers, pay, supervisors, family members, neighbors, licensing information and other VERY personal information shipped to a foreign country just so he can save a few bucks on labor.

Richard, how DUMB are you? A thorough search of your website does not give a HINT to the fact that you have taken it upon yourself to place this HIGHLY sensitive information on perhaps ten, or hundreds of thousands of AMERICAN citizens in the hands of a foreign nation where you have WHAT? Control over it.

How many of the creditors you collect for are aware of your stupidity Richard? INDIA is NOT AMERICA; they do NOT understand our laws, you have put many, many people at risk to line your own pockets, what kind of a NUT are you Richard? To say they are properly trained is ridiculous; to lie and tell anyone this information is safe is criminal. You have sent all this to one of the crime capitals of the world, that’s REAL bright of you Richard. Now you can make more money without worrying if your actions may result in additional crimes on innocent Americans.

Consumers are URGED to make Richard B. Hunter aware of his stupidity by immediately sending the FREE cease communication letter VIA fax to his offices in California. I also recommend that you warn him that he will be held liable for any intrusions into your personal records by anyone he out sources to.

Any organization doing business with Bay Area Credit Services and US Audit Control should be avoided at all costs. Richard B. Hunter, Bay Area Credit Services and US Audit Control should be placed on the watch list for Homeland Security; this man’s GREED is putting too many consumers at risk.

BAY AREA CREDIT

A creditor is not allowed to delete an accurate credit listing, even if it is subsequently paid. It can be shown as paid, but it should not be deleted, unless it should never have been posted.

Why? Are you talking about agreements between the CRA's and the Original Creditor and/or Collection Agency which stipulate accurate entries are not to be removed?
