The ACLU's hateful war against the BSA is one more good reason to support the Public Expression of Religion Act. Let's stop paying the ACLU to destroy America and freedom.
Any loss for the ACLU is a win for Americans.

Suppose they decided being a black kid was a basis for not being a scout, either. Would they still be allowed to recruit at schools? what does believing in a Sky God have to do with learning to pitch a tent? Is the BSA teaching self-reliance or religion?
It is also important to consider what privileges or immunities we are dealing with since a citizen has both privileges or immunities belonging to citizens of the United States and those given to him by a State Constitution and laws.In 1871 Bingham's home State of Ohio highest Court considered the question of whether the State had retained the right to establish separate schools for colored children under the Fourteenth Amendment. In the case of Garnes v. McCan, et al. (21 Ohio State Reports) had unanimously decided by a all Republican court that all privileges to a State school system are derived solely from the Constitution and laws of the State. "The privileges or immunities under the Fourteenth Amendment are those recognized by the US Constitution and belonging to US Citizens, and not those privileges or immunities that are the result of a State Constitution and laws belonging to citizens of a State," the court concluded.
"Equality of rights does not involve the necessity of educating white and colored persons in the same school any more than it does of educating children of both sexes in the same school, or that different grades of scholars must be kept in the same school," the court further added. What is important with this decision is the fact Bingham himself considered the courts ruling "just and proper" when later asked by Garfield if he had agreed with the court's interpretation under the new amendment to the Constitution.
