Former HP Chair Dunn Indicted

The California AG has charged Dunn with four felony counts, but her lawyer claims they've got the wrong person for the wrong reason

California Attorney General Bill Lockyer has charged former Hewlett-Packard () Chairwoman Patricia Dunn and others involved in the company's spying scandal with four felony counts, including wire fraud and conspiracy. "One of our state's most venerable corporate institutions lost its way," said Lockyer at a press conference on Oct. 4 announcing the charges in the month-old scandal. The indictments give Chief Executive Officer Mark Hurd and the company reason to breathe easier, even as they await word from the Justice Dept., which is conducting its own investigation into the case. But they also send a strong message to Corporate America, which is still trying to pick its way through a post-Enron landscape that remains riddled with regulatory and ethical mines.

As expected, Lockyer also charged former HP ethics chief Kevin T. Hunsaker; Ronald R. DeLia, managing director of Security Outsourcing Solutions, an HP contractor; and Matthew Depante and Bryan C. Wagner, two investigators with Action Research Group hired by DeLia to work on the HP investigation (see BusinessWeek.com, 10/4/06, "Indictments Sought in HP Case").

As with he Foley situation - medical excuses are the best cover going. If it was true that she had been treated previously at a particular hospital/clinic - all she has to do is release a press statement saying she is going back for treatment. The facility is prevented by HIPPA restrictions from releasing any information about her without her permission. It could be a flat out lie - but she's not under oath - there is no downside to releasing such a statement as a public sympathy builder. Same with Foley, though I doubt it bought him much.

IIRC, hospitals will say whether someone has been admitted, but can give no specific information.

Not lately. As a lawyer, with clients who are sometimes hospitalized, I have run into the situation where a patient I had visited one day is moved to a different room in the same hospital the next, and the hospital will not acknowledge that the patient is/is not in the facility. Fortunately there is usually a family member who knows and can advise me - but in the recent case of a childless, estranged individual who was in his final days - the hospital wouldn't admit that he was in the building. It certainly has substantial privacy benefits, and I'm not criticizing that - it's just that it has become the refuge of choice for those in Foley/Kennedy's shoes or for scam artists (pleading for contributions for the sick child, etc.) There is no way for the press or anyone to establish, objectively what is true regarding these claims (i.e., did Patrick Kennedy really go to the Mayo Clinic, or did he just lay low in Florida?)
