I've always thought the whole fiasco started because the boys were disappointed at the sight of their dancers--beat up and cut up, bruised and worn out. I think disparaging comments were probably made, probably the "n" word was heard, and I think that set the dancer off.

She showed up in court wearing that? She really needs to consult with Naomi Wolf. A black or gray pantsuit with a turtleneck sweater or bow tie blouse would have worked SOOO much better.
No, I've just read published interviews with the other dancer. She said she arrived first and the boys thought she was hispanic (she is black and Korean). Then when "Precious" arrived there was some disgruntlement because they thought they did not feel they were getting what they had requested when the performance was arranged.
That has to be the king non-sequitir of all time. The NYT is really reaching to get a halo on this guy.

Experts have said it appears Nifong's case is based only on the testimony of the accuser, who has told wildly different versions of the alleged assault.

That IS coming. The one crime you can commit in America which guarantees you will go to prison and/or suffer major kinds of consequences is to embarass the power structure, and the Fong has done that. Those guys might in fact not be of a mind to call it quits with whatever they do to Fong, they might visit their wrath upon the city of Durham itself i.e. disincorporate the place and let it be a geographical location like the Okeefenokee swamp or something. Durham does not deserve to be a city.
P.S. Have you considered that this team was bonded together and that one of the members at the party was black. Do you really think that these boys would be disparaging the color of the dancer with their teammate present?

Here's how this thing "ends"
Nifong is permitted to step down, the state appoints a black special prosecutor, who interviews the "victim", looks at the facts and decides that there is not enough to pursue the prosecution, and drops the case.
By appointing a black prosecutor they are hoping to avoid the racial tension that results when the charges are dismissed.
Everyone "wins"-the accused are off the hook, there is no rioting, Nifong serves out his term as DA and gets his pension.
The fact that Nifong played the black voters of Durham like a fine violin will be ignored.
The fact that the "88" will go back to their cushly lives at teachers will be ignored.
The fact that much of the media (Jim Rome) tried and convicted these guys in the media will be ignored.
And the fact that Duke threw these kids out on their collective asses will be ignored.
I hope the three accused sue the living ship out of Duke, the likes of Jim Rome, Durham and the accuser.
And file criminal charges again Nifong.
A man living near the town in which I reside was a CO during Vietnam but with a twist. He refused to carry a weapon but he volunteered to be a medic in a combat unit in Vietnam. The Army accomodated his request. He had integrity.
It won't be so easy, Victoria Peterson, chief lunatic in Durham is demanding that the case NOT be dropped. Don't underestimate the power of the lunatic fringe - they brought it this far.
Here, let me fix that...
And the first thing that special prosecutor should do is dismiss the charges file criminal charges against Nifong.

There is really no reason for a special prosecutor, if the AG determines that there is no case against the lacrosse guys.
The AG, if he agrees, should just hand it back to Mr. Nifong. No conflict of interest could cause any problem with Nifong doing what he should do, just go to court and move to have the case dismissed.
