The charges that they were convicted of should never have applied to the Agents and are the basis for the lenghthy sentence. What charges are brought against defendants are at the discretion of the prosecuting Attorney. Sutton was definitely overzealous, IMO, despite his continued rhetoric. Read this letter (PDF) from Congressman Walter B. Jones to AG Alberto Gonzales. It's astonishing.
Sutton prosecuted the agents on ATTEMPTED MURDER! At least he didn't succeed in bring that conviction home.
I agree. These officers were dealt with far more harshly than the average career criminal. I am completely unconvinced by this prosecutor's glib language about how effective he is in prosecuting criminals, and how wonderful most Border Patrol officers are. He's a typical lawyer, very glib, superficially persuasive, and full of himself, but he doesn't convince me that he is honest. Based on sorry personal experience, I will never, ever trust the legal profession or the judicial system again. Nor do I trust G. W. Bush and his "Republican" establishment ilk, who have destroyed the conservative movement in this country.
Could it be 14 attempts to get this prep to stop running and then one well placed intended to stop him from running NOT kill him.
Hmmm - maybe this wasn't deadly force, but a well restrained use of deadly weapons?
I don't expect him to pardon them.
Even accepting the contention that they filed a false report, Sutton was overzealous IMO. It would have been sufficient if they had simply been fired from their jobs.
After reading your post about this prosecutor's political connections, I suspect that his massive over-zealousness in this case is probably due to his lust for higher office. This guy is probably another ambitious Republican party hack, who (like Bush) is staking his future on attracting "Latino" voters, many of whom view law enforcement against illegals and Mexican citizens as "racism."
Don't be fooled by this presecutor's rhetoric, folks. Rhetoric and glibness is what lawyers are good at (and about all most are good for).
If we put on our tinfoil hats maybe we can find away to blame President Bush for this :)
Every time Sutton opens his mouth, the rhetoric is escalated. As recent as this past Wednesday, he reiterated the "shot in the back" allegation, despite testimony from doctors that the bullet entered his buttocks from the side.
He says that the agents never reported that they thought Aldrete-Davila had a gun, yet it was in the DHS-OIG report from March 2005 documenting Compeans statements.
Also this past Wednesday, during the White House daily press briefing, Tony Snow told reporters: "And a lot of the allegations about a scuffle and discovering drugs at the scene and all that, they're simply not supported by the fact record of the case." I was stunned reading that. Those facts are in evidence and not even disputed!
The list goes on and on and Sutton et.al. get less credible every day.

Thanks for posting this. It would seem to completely rebut every allegation by prosecutor Sutton. Something is very rotten in the Bush Justice Dept. Remember that same dept. gave Sandy Burglar a slap on the wrist for stealing documents from the National Archives. When are people going to realize: George W. Bush is not a conservative!
Actually, the answer is yes.
We allow murderers to appeal and be free on bond (depending on the sentence) yet we will not allow these 2 agents to be free while they appeal ?
The justice system is very flawed. Especially in Texas.
And don't tackle him too roughly, you could give him a boo boo and damage his self esteem.
What was the perp worried about? He would be deported? He was running to the border and there was no taco bell in sight. He did not stop running after many warning shots - I guess he was just lonely for home - huh!
Sutton: That is not my call. That call is up to the president and the White House.
Not a very honest answer from the US Attorney for the District of West Texas.
According to Section 1-2.111 of the DOJ's Standards for Consideration of Clemency Petitions, the US Attorney plays a BIG part in any clemency or pardon petition:
"The views of the United States Attorney are given considerable weight in determining what recommendations the Department should make to the President. For this reason, and in order to ensure consistency, it is important that each request sent to the district receive the personal attention of the United States Attorney. Each petition is presented for action to the President with a report and recommendation from the Department, and the recommendation by the United States Attorney is included in this report."
Sounds an awful lot like the excuses the SS officers used in court after WWII.
"I was just following orders."
