Report: Court to reject Bosnia's genocide lawsuit (Bosnia vs. Serbia)

THE HAGUE -- The International Court of Justice today decides on Bosnia’s genocide lawsuit against FRY.

The lawsuit, brought against the former Federal Republic of Yugoslavia (FRY) in 1993, claims that FRY was responsible for alleged genocide that took place during the 1992-1995 war in Bosnia.

The United Nation’s highest court’s ruling in the case will be presented to the public on February 26, by Judge Rosaline Higgins, on behalf of a panel of 15 judges.

Belgrade daily Blic reports today quoting from sources close to the court that Serbia will not be found guilty of having committed genocide against Bosnia.

The daily reports the International Court of Justice will rule that although war crimes against the Bosniaks and Croats have undoubtedly been perpetrated by Serbs, Bosnia’s lawsuit will be rejected on grounds of insufficient evidence that genocide took place on a state level.

The former state union of Serbia and Montenegro (SCG) disputed the International Court of Justice’s jurisdiction in the case, stating that at the time the lawsuit was brought against it, FRY was not a UN member-state.

The country’s legal team also rejected claims that genocide took place in Bosnia, and that official Belgrade could be held responsible for the crimes that occurred during the war in that country.

INTRO: A university law professor says his position as an independent U.N. human rights investigator in Afghanistan was abolished under diplomatic pressure from Washington. The United States denies the charge, saying the human rights situation in Afghanistan has sufficiently improved to the point that a special monitor is no longer needed. VOA correspondent Gary Thomas reports from Washington.

TEXT: Charif Bassiouni says his job as a U.N. independent expert on human rights in Afghanistan was not renewed late last month because of his attempts to look into alleged rights abuses by U.S. forces.

Mr. Bassiouni, a professor of law at DePaul University in Chicago, had expected a routine two-year renewal by the U.N. High Commissioner for Human Rights when his mandate expired last month. But, talking from his Chicago office, Mr. Bassiouni, who had previously served as chairman of the U.N. Security Council's commission investigating war crimes in the former Yugoslavia, says he was warned that there was diplomatic pressure not to extend his Afghan mandate...

Isn't it amazing to find such a dedicated Dhimmi playing kneepad-wearing cheerleader for the Jihadists at a place like Free Republic?

Well not really although it is unusual they last as along as he has. I have run into him before and a few others. But I do know what you mean you normally discuss things with logical people here, however; there are dhimmi excuse making fools many in government itself.

I really come here to read and occassionally post but its a waste of time to even talk with people who don't understand that TROP is at war with the world and Kosovo is the next Afghanistan in the making, thanks to BJ Clinton.

The lawsuit was initiated and brought about by a U.S. professor from the University of Illinois, Francis A. Boyle.

So, it's rather hypocritical that a citizen of a country which doesn't recognize the court for itself (U.S.) will use that court to attack another country. This shows it is being used vindictively and as a political weapon.

He later resigned from the case - after it got going - and some speculated it might be because he is ethnic Irish and dabbled in some issues concerning the IRA or something.

Dr. Francis Anthony Boyle, is a professor of international law at the University of Illinois College of Law. He is a graduate of the University of Chicago and Harvard Law School. He also received a Ph. D. in political science from Harvard University.

Between 1988 and 1992 Boyle was a member of the board of Amnesty International USA. He threatened to sue Amnesty for what he perceived as bias in its coverage of abuses against Palestinians' human rights; he has since been a critic of the organization. Boyle also charged that Amnesty's staff had been infiltrated by US and UK security services (see Covert Action interview below).

From 1991 to 1993, Boyle was a legal advisor to the Palestine Liberation Organization. Boyle is currently attorney of record for the Chechen Republic of Ichkeria and a member of the Nobel Peace Prize for Governor George H. Ryan Committee.

Professor Boyle is a controversial figure at the University of Illinois. He worked to prevent a war between the United States and Libya in the 1990s, and speaks fondly of his interactions with Muammar al-Qaddafi. Professor Boyle has taken a strong stand against the actions taken by the United States in Afghanistan and Iraq following the September 11, 2001, attacks. He nevertheless maintains a highly visible public profile for a law professor, making appearances on such interview shows as Fox's The O'Reilly Factor and Moneyline with Lou Dobbs.

Boyle is a United States citizen, but also holds honorary citizenship of Bosnia-Herzegovina, which he received in 1993 while he was an adviser to Bosnian war-time president Alija Izetbegoviæ.

Boyle has also taken a strong stand in favor of Hawaiian independence and against a University of Illinois "pub crawl" that occurs on St. Patrick's Day, arguing that the latter is offensive to persons of Irish nationality. In the former he uses a resolution signed by former U.S. President Bill Clinton apologizing for U.S. involvement in the overthrow of the Hawaiian monarchy as justification for Hawaiian independence. In the latter, he filed a complaint with the U.S. Department of Justice's Civil Rights Division, claiming that he had to endure a "hostile work environment."[1]

In 2002, Boyle protested a speech by Ruth Wedgwood, a law professor performing consulting work for the Bush administration, by equating her advocacy of military tribunals in the War on Terror to kangaroo courts. He underlined this point by accompanying an individual dressed in an anthropomorphic kangaroo costume, referred to as "Wedgie the Kangaroo".

More recently Boyle has been on the vanguard of movement to impeach U.S. President George W. Bush.

The US DOES recognize the International Court of Justice (aka World Court) where the suit was brought.

It does not recognize the International Criminal "Court" (ICC, designed and championed by Cherif Bassiouni).

But our government is against the ICC for the wrong reason. If it were against it for the right reason, it would join me in saying, "Abolish ICTY"!!!

It makes no difference what you give hippylite, he has an agenda and even if you had photo's, trial witnesses face to face with the boy, it would make no difference. Its a total waste of time. However, the one good part is that you can use this individual when you need to as a conduit to express your facts and spread the truth. He is a vehicle to use for this purpose. :) You are right on target and I agree with you completely.

hey tom...over on LF, did you notice the post of that arab, ahlam putting up a pic of that soldier in the medevac chopper? It was hilarious when I knew that soldier from way back when...Gulf War 1.. He graduated same time from H.S but from another school district.

my gosh it was hilarious he was attempting to spread more lies and using that picture as it were "today". lol

DEBBIE WHITMONT: Though the KLA were Muslims, David Hicks, at that stage, wasn't. He told the Australian Federal Police he joined the KLA to help the Kosovo people.
