Former Edwards County Deputy Sheriff Gilmer Hernandez was sentenced to 12 months plus one day by Federal Judge Robert T Dawson. We will have a full story and pictures by 4 p.m. Hernandez was convicted December 1, 2006 for violating the civil rights of an illegal alien when the Suburan in which she was hiding attempted to flee a traffic stop made by then-Deputy Hernandez. Hernandez fired his handgun at the Suburban's tires and a bullet fragment struck the illegal alien in the mouth.

Unbelievable. Why isn't this in the MSM? This guy should never have been prosecuted. Never.
I guess we can't have anything interfering with the cheap labor being supplied to US companies, eh? I'm sure these corps donate to political candidates big time. And yes, I'm trying to understand the "why" of the illegal alien problem and why it is not only being allowed, but actively promoted.

Edwards deputy gets jail time for shooting

DEL RIO A federal judge sentenced former Edwards County Sheriff Deputy Guillermo (Gilmer) F. Hernandez to a year and a day in jail this morning for shooting at a fleeing vehicle transporting undocumented immigrants and injuring one of its passengers.
Although U.S. District Judge Robert T. Dawson denied pleas from Hernandez and his lawyer for probation, the judge did deviate from federal sentencing guidelines that made the former deputy eligible to be sentenced to up to 9 years in prison.
Hernandezs attorney Jimmy Parks Jr. expressed mixed emotions afterward.
Im so appreciative of that, Parks said of the judges more lenient sentence. But as an advocate and friend of Gilmers, I didnt want to see him spend any day in jail.
Hernandezs case gained nationwide attention after a federal jury convicted him Dec. 1 of violating the civil rights of a Mexican woman who was being smuggled into the country along with several other undocumented immigrants in a Chevrolet Suburban.
After pulling the Suburban over on a traffic stop in April 2005, Hernandez fired several shots at the vehicle when the driver attempted to flee. Maricela Rodriguez-Garcia suffered a facial wound.
Hernandezs attorneys argued the deputy was trying to protect himself, fearing the vehicle might turn on him. Prosecutors claimed otherwise, saying the deputy faced no eminent threat and abused the color of law.
This morning, more than 100 residents from Hernandezs hometown of Rocksprings gathered outside the federal courthouse in Del Rio to show their support.
They carried signs saying, Free Gilmer, and Please Let Gilmer Come Home.
Hernandez has been held in jail without bond since his December conviction.
Parks said Hernandez will get credit for the 110 days he has been in jail and is eligible to receive credit for good behavior since the judge sentenced him to a day more than a year in jail.
Parks said Hernandez could be freed in about six months.

Bush should be impeached for his despicable failure to uphold his oath of office. Supporting a foreign government and it's policies over the laws of the United States is a high crime.
If you read the Ramos/Compean transcripts, you will see that prosecutor Kanof told the jury in her summation that if Ramos&Compean had reported the shooting they would have been cleared, and that, indeed, BP agents are always cleared when they report a shooting. Hernandez reported this shooting, and the sheriff and Texas Rangers were not going to prosecute.
Kanof didn't want to tell the real story: if Mexico tells Sutton to prosecute, he will do his damndest to do so, and will seek the harshest possible punishment, regardless of whether the LEO reports it.
Also note that Sutton wasn't one of the 8 federal prosecutors that Alberto Gonzalez fired recently.
12months and a Day also means he has to go to the pen and not do his time in county.
Why isn't this in the MSM??
Because the MSM believes Hernandez deserves it and they don/t want him to gain more supporters.
