State Bar schedules Nifong's hearing

DURHAM - District Attorney Mike Nifong will have an opportunity April 13 to tell an N.C. State Bar panel why he thinks part of the case against him should be dropped.

The hearing, before the Disciplinary Hearing Committee, is scheduled for 4 p.m. in the third-floor courtroom of the N.C. Bar Building, 208 Fayetteville St., Raleigh.

The bar has charged Nifong, a veteran prosecutor, with violations of ethical and professional conduct over his handling of the case in which three members of the Duke University lacrosse team were accused of sexually assaulting an escort service dancer at a team party.

If convicted, Nifong could lose his law license.

David Freedman and Dudley Witt, two Winston-Salem lawyers representing Nifong, have asked for dismissal of perhaps the most serious charge: withholding DNA evidence favorable to the defense and lying about it to court and bar officials.

Katherine E. Jean, Carmen K. Hoyme and Douglas J. Brocker, lawyers representing the bar, argued against such a dismissal. In a brief filed last month, bar attorneys described Nifong's arguments as "semantic hair-splitting."

It would be a surprise if this was dismissed.

Nifong should be disbarred and prosecuted. He’s been lying his ass off since this fiasco started, and will continue to do so until he is behind bars where he belongs.

Considering the NC Bar has already criticized Nifong for his lame attempt at making excuses, even rebuking him in public, tells me you are right. He is toast.

Wonder if Duke faculty members will take out an ad, skewering Nifong, putting heat on the bar association and encouraging protests against Nifong as the hearings progress.

Nifong will get a disbarment for a year. Being an elected official, He may keep his job regardless. No way he will do any jail time. Media coverage will only be minimal. You all know the drill for liberals.

I agree Nifong will behind closed doors be told not to pull this crap again, then in the public court be heralded as a whistleblower or some such. In a year or two he’ll be back at it, only next time he’ll scale back his attacks and go after those white males which he will have a sure win against. At least until someone finally gets fed up with him, and gives him the ole’ heave ho off a fishing boat in the gulf at midnight.

There is a bill before the NC legislature that would remove him if he is disbarred. I believe the state Senate is taking it up today.

I think he will be disbarred for longer than a year. He has really dissed the bar.

Even if this guy keeps his law license (snowball’s chance....) he is going to be sued into oblivion. He’ll be working the rest of his life, at McDonald’s wages, to pay off his soon-to-be judgement against him. With Bankruptcy laws as they are, he won’t be able to discharge the judgements these kids will surely get against him. If he is disbarred, it will make their lawsuit against him go pretty easily......

I visited with a former member of this ethics committe. I won’t say who or where.
He said that this guy will take a solid hit the way he sees it.

Yes. If a lawyer does something that's badly wrong, having other lawyers deny that it was wrong will cause less harm to the legal profession's reputation than admitting to it, unless it is so outrageously wrong that nobody would believe the denial. In that case, other lawyers will pound the person into the ground, to reassure the public of their willingness to deal with bad eggs.

Nifong is toast.
