I understand that he had the option of a trial, but elected to a settlement instead. He agreed to a settlement, but threw a tantrum when it came time to sign it. The judge ruled that he wasn't bargaining in good faith and threatened to find him in contempt over the tantrum. He then threw a second tantrum and left the state.
If a settlement was reached and agreed to, what was there to mediate? Wouldn’t an agreement nullify the need to mediate?
Wouldn’t a judge be overstepping to jail a person for a moot order?
What about the underage girls, because from what I understand that is what the charges are for.
Isn’t this the guy that had someone break into his house, take videos of him in uncompromising positions and having to say things to make it sound like he was gay?
They eventually caught the guy but I think Karma is a B&*%^ch.
It wasn’t a disgruntled dad, just a blackmailer that I think he met through Paris Hilton.
You said — “These girls whored themselves three times: First, when they created [& then presented] the fraudulent identification papers; second, when they accepted the original payment from Francis; and third, when they went back to the till for the civil lawsuit payment.”
Just a comment, not directed specifically at you, but to everyone, in general...
Well, these girls (and hundreds of thousands of others in this country) are doing the very same thing, for free, no papers to sign, no ID to present, with many private “filming parties” going on at many of the parties they go to. You’ll probably find many of these girls “on film” with many of the guys carrying around video cameras and distributing these films for free.
I would say that for every filming that you have with this outfit, who are supposed to meet strict legal guidelines for doing these videos, there is (at the very same time) about 1,000 other filmings going on, with significant numbers of underage girls (that same night), doing it for simply the heck of it (and because “that’s what everyone is doing...”).
I would call them s&f parties (if you don’t know... s**k and f**k parties), that’s how bad it is...
So, the problem is not so much Girls Gone Wild, nope — the real problem is in the society, or more specifically, within that 13-18 year-old age group.
I would stop blaming this guy for the ills of society and start blaming the parents, and then *also* the kids themselves...

The overiding factor is that he is a predator plying girls with drinks....
In many cases, these girls are underage and had never stated they were anything but....
People invest money with Con Artists then regret their “poor choice”
This guy is no different except he deals in porn and preys on the young....
Sounds like that bill would include the mediator and the plaintiff’s attorney’s fees for an aborted mediation. If mediators are getting that much a day there, I need to move and change jobs.
He’s getting hammered for walking out of the mediation, per the story posted here. If he’s got a settlement agreement all signed up, it should get him out of jail. I’ll bet he doesn’t.
You said — “What about the underage girls, because from what I understand that is what the charges are for.”
Yeah, and what about all the other 13-18 year-olds, doing it for free, no ID required, no paperwork to meet — at all the s&F parties going on. I would say that on any particular night, you would probably have about 1,000 others going on across the country, anywhere from two or three to a whole group, with someone filming. It’s pretty rampant out there and there are lots of videos being made privately (or not so private, when they get on the Internet)...

Agreed. I never believe in the dicta of “in vino veritas” or that inebriation has no effect on the ability to consent clearly. There’s a avery good reason why contracts are null and void if the person who signed it is under the influence.
If these girls are, then their “contract” is null and void.
The “girls” got a financial settlement from this guy. Won’t they love their children seeing the Girls Gone Wild when they are in their 40’s?!!! thank God the internet wasn’t around when I was in college-many party nights where who knows what might have occured if cameras were rolling!!!
Now, what is more destructive: an underage girl flashing her boobs, or a 26 year old female teacher having sex with an underage male student ? Freep threads seem to laugh off the latter, while I can assure you I would get Medieval on any whore who molested my child. The double standard is sickening.
You said — “The overiding factor is that he is a predator plying girls with drinks....”
I seriously doubt that. These kinds of girls are going to parties and drinking on their own. Many of them will do so with fake ID. And if not that, then others (friends or acquaintances) are getting it for them. It doesn’t take a “predator” to get these girls drunk these days. Just send a girl out to a “party” and she’ll be getting drunk on her own...
You also said — “In many cases, these girls are underage and had never stated they were anything but....”
Yeah, and the same thing is going on with many 13-18 year-olds around the country. Everyone around them knows that they are that age or under. It doesn’t bother anyone at these s&f parties that these girls go to — and also go to knowing what happens at them, too.
It’s about time that the blame gets put on these kids who are doing these things and going to these kinds of parties. They seem to “revel” in doing these things — and even revel more at the thousands of other “free filmings” that they engage in at these very same parties...

This is a civil case.
No jail other than for contempt.
He is in jail because he was stupid enough to fall for a lawyer’s trick. These are plaintiff’s lawyers who are playing games to get money.
You can’t go to jail for not reaching settlement many mediations fail. The mediator signs off indicating an impass and the parties go to trial.
People have stormed out of mediations. Lawyers have intentionally impassed trials in order to go to jury trials thinking they will do better. (and then they jury comes back with zero)
we are not getting the full story.
I assure you, neither is a luaghing matter to me. If there is true justice, the man who plies underage girls with drinks and the teacher abusing children will meet the same fate either in prison or in the chamber.
This film company has been sentenced to pay $1.6 million in criminal fines for failing to create and maintain age and identity records from the time period of the underage girls. How confident are you that realistic looking Identification was presented?
You said — “Now, what is more destructive: an underage girl flashing her boobs, or a 26 year old female teacher having sex with an underage male student ? The trouble is, that the culture that the girls are presently raised in — and *especially* if they are going to public school (and many times in private schools, too) — these girls actually “revel” in being filmed at doing lots of things with guys, in much more destructive ways than simply flashing boobs (and that’s not necessarily such a good thing, itself, either — because it represents a mentality for them, which leads them down more destructive paths).
So, these girls (and many girls of parents *here* on Free Republic) are engaging in these s&f parties and being filmed for free, because it’s the rage and the fun thing to do these days. There’s no problem with them. They seem to think it’s okay (even though it’s destructive to them). As I’ve said in several other posts, there are probably 1,000 other private (really “not so private”) filmings going on with 13-18 year-old girls on any night of the week. One of them could be your daughter on any one particular night. And, you’re not going to know anything about it.

“This world needs more personal responsibility...”
I would agree. Joe Francis must accept personal responsibility.
