Payout to S.F. ex-employee who had affair with Newsom called legal

An investigation by the City Attorney's Office into whether it was proper for Ruby Rippey-Tourk to receive thousands of dollars in "catastrophic illness pay" from the city after she left her San Francisco City Hall job -- and following her affair with Mayor Gavin Newsom -- uncovered nothing illegal, but did raise questions about whether she should have been eligible for the payout.

The report questioned, however, whether Rippey-Tourk, who took leave from City Hall in May 2006 to enter a substance abuse program, should have been eligible for that program.

City Attorney Dennis Herrera opened the investigation into the payments in February after Newsom publicly apologized for having an affair with Rippey-Tourk, who is married to Alex Tourk, Newsom's former deputy chief of staff and former campaign manager.

They also noted, however, that the probe was hindered by Rippey-Tourk's refusal to let the City Attorney's Office access her confidential medical records.

The report said investigators were unable to find any other instances where substance abuse was listed as the sole reason for acceptance into the CIP program. They also found other cases in which DPH refused applications because substance abuse was the sole catastrophic illness.

And, it raised questions about whether Rippey-Tourk -- who remained on leave until a resignation she submitted July 21 became effective Sept. 1 should have continued to get paid after she indicated her intent to leave the city.

"We could not find another instance where, as here, an employee received approval by the controller for payment under the CIP after she indicated her intent to resign from city employment and received the payment just as she was starting a new job," they wrote.
