WASHINGTON — The Supreme Court upheld the nationwide ban on a controversial abortion procedure Wednesday, handing abortion opponents the long-awaited victory they expected from a more conservative bench.

The 5-4 ruling said the Partial Birth Abortion Ban Act that Congress passed and President Bush signed into law in 2003 does not violate a woman's constitutional right to an abortion.

I do not like his stance on immigration either, but he has always been upfront about his stance even before the 2000 election and has never wavered. I respect that.

Isn't it amazing how Ruthie takes this from her self centered world and not that of the constitution:
"Today's decision is alarming," Justice Ruth Bader Ginsburg wrote in dissent. She said the ruling "refuses to take ... seriously" previous Supreme Court decisions on abortion.
It is the EXACT OPPOSITE of what she is saying. The Supreme court is NOW taking seriously what was done in previous rulings and has finally begun to be serious about the constitution. Thank God the Supreme Court has some judges with a conscience now.

This is one of the most ignorant things I have ever seen posted from them. I had my baby girl die at 30 weeks five years ago. She was vaginal delivered after 24 hours of proper care in the hospital. A stillborn baby is delivered just like any other live baby - this PBA procedure is NOT the usual way of usage on a stillborn - Its major usage is for killing babies!

GWB will always be special to me, no matter how many people try to destroy him. I will admit he made some mistakes but what President hasn’t? He hasn’t been given his due during his time as President but people will look backone day and appreciate him.

You had to add but he has been wrong on, etc. That was not necessary. People need to grow up. None of us can get everything we want. GW is a damn great president and history will judge him as such. GW's bashers are nothing but pathetic and deserve another Clinton and not someone the quality of GW.

Pope John Paul often spoke of the culture of death, given what we witnessed via Schiavo, VT, and with radicalized Islam, perhaps with this ruling, the tide will turn back, ever so slowly. Could this be a turning point back towards grace?

The procedure at issue involves partially removing the fetus BABY intact from a woman's uterus, then crushing or cutting its skull to complete the abortion.

Abortion opponents say the law will not reduce the number of abortions performed because an alternate method — dismembering the fetus BABY in the uterus — is available and, indeed, much more common.

Clarified.

“Ginsburg said the latest decision “tolerates, indeed applauds, federal intervention to ban nationwide a procedure found necessary and proper in certain cases by the American College of Obstetricians and Gynecologists.””

And in saying this she again reveals herself to be a moron who never should have been appointed.

There IS NO medical condition that necessitates this barbaric action and the doctors she cites never said there was.

Yep, we are in agreement. The reason that the federalism issue was not raised is because the ban was (to state the obvious) challenged by supporters of Roe v Wade and they know that federal authority over abortion is a central tenet of Roe v Wade. If they challenged on the basis of federalism and they won then it would be a pyrrhic victory on their part, because that would undermine a key pillar of Roe v Wade. They would win the battle by risking the war, much as in this ruling opponents of Roe v Wade have won a battle by risking the war. Unfortunately, the status quo puts opponents of Roe on shakier ground than proponents.

What should've been done by opponents of Roe was to get another state to pass a PBA ban, slightly modified from the Stenberg ban, and to thereby give the Court a case with which to effectively reverse Stenberg.

I am not arguing that it does unless you consider that my use of it to justify denying one type of abortion thereby legitimizes other types. No, it only says this method under review can be legislatively denied.
