WASHINGTON — The Supreme Court upheld the nationwide ban on a controversial abortion procedure Wednesday, handing abortion opponents the long-awaited victory they expected from a more conservative bench.

The 5-4 ruling said the Partial Birth Abortion Ban Act that Congress passed and President Bush signed into law in 2003 does not violate a woman's constitutional right to an abortion.

The 14th Amendment gives them the authority.

That's a bit of a stretch, but I can see how it would be a popular argument.

I’ve read that among single-issue voters on abortion, the anti-abortion voters outnumber pro-abortion. Not by a whole lot, but still.

I seriously doubt that. Most people feel that Roe is safe and don't really care that much about abortion. If the message gets out that Roe is seriously under attack then the Republicans will take a monumental beating in 2008.

No, Roe only protects the first trimester, Doe vs. Bolton covered the whole nine months by introducing the health exemption

Roe & Doe were a package deal.

Taking a cheap shot on a day when he has helped many, many future children. Sad and very pathetic. You deserve another Clinton and not someone the quality of GW.

How is it a cheap shot to respond to myriad posts that claim that Bush is a "true conservative" when he really is not?

Bush has always been anti-abortion and in line with the religious right. That has never been disputed by anyone.

Excellent point. People who are pro-life and then are pro-Rudy need to WAKE UP. This ruling is a big reason why knowing a presidential candidate’s morals is crucial.

Sure, if it’s Rudy vs. Hillary after the conventions I’ll vote for the Mayor, but at this point supporting a pro-abortion lib is selling out.

Nope. See the 14th Amendment.

What is your rationale behind this statement. BTW, I am familiar with the due process clause of the 14th amendment and if the SCOTUS felt that it applied to the unborn then Roe would have been ruled in the opposite manner.

The lie that conservatives stayed home en masse on election day and inflicted a left-wing Congress on the country as punishment for a lack or “purism”.

It’s a flat-out lie, pushed by liberal republicans to smear conservatives. It simply didn’t happen, and the number bear that out. The Dems won because the independent vote broke 65-35 against the Republicans. That’s it.

I agree...late-term (partial birth) abortions are murder because the fetus/baby is generally viable at that point with current medical technology...and I’m a godless heathen atheist who thinks religion and mysticism is a complete waste of time...I agree on purely scientific grounds.

Bush wasn’t the wimp, Frist was. That said, you don’t even realize that Bush 43 has singlehandedly rescued the federal courts from disaster.
