An 18-year-old accused of trying to dump Linda Damm's decomposing body is being offered a plea deal that includes no prison time but the case has stalled because he doesn't want a felony conviction marring his record.
Jared Guy is charged with being an accessory in the February slaying of the 52-year-old Lafayette woman. Police say Guy helped try to dump Damm's decomposing body in an Erie landfill and then bury it in Boulder's Green Mountain Cemetery after murder suspect Bryan Grove asked for assistance.
Guy appeared in court Thursday for what was supposed to be a plea agreement to end his case. Instead,he pleaded not guilty, and trial was set for Sept. 10.
Boulder County District Court Judge Lael Montgomery asked attorneys about the likelihood of reaching an agreement before then, and both sides said they weren't sure.
"There is an offer on the table, and it's not very likely it's going to change," prosecutor Karen Peters said.
Guy shared details of the plea offer with his friend Keri Smith, who attended Thursday's hearing. She said that even though he faces only probation in exchange for his testimony against Grove and 15-year-old Tess Damm, Guy is most concerned about having a felony conviction on his record.
"He keeps saying, 'I have to go to college. I need this off my record,'" said Smith, 16.
A source close to the case confirmed that Guy has been offered such a deal, and is balking at a possible felony conviction.
A day after Damm's body was discovered stuffed in the back of her Subaru inside her garage, Guy was awarded the Metropolitan Mayors and Commissioners Youth Award by Boulder County commissioners for overcoming adversity and serving as an inspiration and role model. He is expected to graduate this spring from New Vista High School, and has aspirations of becoming a chef and moving to New York City with his girlfriend, Smith said.
"Basically, he wants to go back to a regular life," Smith said.
Guy was arrested two days after Grove, Tess Damm and Jared Smith were taken into custody, nearly a month after the slaying. Grove, 17, is accused of stabbing his girlfriend Tess Damm's mother to death during a fight over the woman's alcoholic and abusive behavior.
Guy told investigators who had tracked him down with his girlfriend at a winter dance at Westminster's Standley Lake High School that he urged Grove to go to police after the killing. But when Grove wouldn't budge, Guy said, he agreed to help dispose of the body.
Guy and Grove were adopted as babies from orphanages in India, and they share a tight bond as "brothers," according to police and friends.
Guy's defense attorney, Keith Pope, told the court that his client is susceptible to peer pressure and manipulation because he was born premature and received poor care in the orphanage.
Jared Smith, 16, was accused of helping Grove move Damm's body from her bedroom to the back of her car the day she was killed. He pleaded guilty last month to a juvenile charge of accessory and was sentenced to two years in juvenile prison.
Tess Damm is charged as an adult with conspiring to kill her mother, and Grove is charged as an adult with first-degree murder.
They are expected in court for a preliminary hearing May 21.

If a 16 year old does not understand he should not help hide a body he is headed for much much trouble in life.

Why? Lots of liberals who'd been former terrorists, suppoert terrorism, and/or have participated in murders have ended up TEACHING in colleges. This may give you a leg up.
