Sandy Berger and the Clinton Cover-Up - Why It Matters

On May 17th, Sandy Berger, President Bill Clinton's National Security Adviser, voluntarily gave up his law license and with it the right to practice law. That is a stunning move for an accomplished lawyer, one of the nation's most influential public officials. Someone should take note. In fact, everyone should.

Berger previously entered a deal with the Department of Justice after he was caught stealing and destroying highly sensitive classified material regarding the Clinton Administration's handling of terrorism issues. That deal allowed him to avoid jail time, pay a modest fine, and keep his law license. It also allowed him to avoid full explanation of what he had taken and why he had taken it.

What information was worth risking his reputation, his career, and his freedom to keep hidden? And who was he risking that for?

Recently, the Board of the DC Bar, which had granted Berger his license, began asking those questions. There was only one way to stop that investigation, to keep from answering questions about what he did and why he did it, to keep the Bar from questioning his colleagues in the Clinton Administration about what had been in the documents Berger destroyed.

Berger took that step, surrendering his license, and stopping the investigation.

Ordinarily, anyone who has spent the time, effort, and money needed to master one of the "learned professions" fights with the utmost determination to keep his license. That is not merely a ticket to practice your chosen profession - it is also a badge of honor and accomplishment. Ask any doctor or lawyer, any architect or CPA, any professional at all, what it means to give that up.

That Berger didn't fight speaks volumes.

Many Repubs took note; apparently not the one's that mattered however. Did our Congressional Repub Leadership take note (beyond a lone voice or two)? For that matter, do not recall President Bush ever weighing in here. . .

Have noted as well; the reluctance of Justice to execute just that; on America's behalf. Could not even muster 'will' to have Sandy honor the obligatory lie detector test as per his terms of agreement. Justice of course, has officially, 'closed the case'.

So. . .beyond Burger; WHO is taking note of our Justice Department; and it's efforts to subvert the truth - so as to protect and enhance the Clinton 'legacy'. A legacy that boldly recasts, not only the Clinton's past; but ours; and by turn, alters the probabilities from which our future - America's future - unfolds.

(Beyond Burger. . .beyond Plame/Wilson. . .beyond CIA. . .beyond Bush Administration; what has Justice Deparatment wrought; on it's own behalf. . .and WHY are they getting away with it?)

These people protect their past; alter our future to their advantage and think nothing of it.

They think only of their 'higher cause'; their agenda; which is to reduce America to an international 'level playing field'; while enhancing their own personal power; enriching their pockets; and becoming 'one' with the mega power brokers who are the enemies of America, as it is Constitutionally intended.

We have seen enough to know there is NOTHING they will not do; to move America down. . .to where they think our country belongs. They are determined that ideologically, Capitalism and Democracy do not stand as 'superior' to what is inferior; their own socialist 'ideals'. . .

Whether historical evidence. . .Elections. . .U.S. Military. . .lives of friend or foe. . .for these people, there is NOTHING; NO ONE; NO truth; to inconvenient to alter.

The only person who knows what information was lost is Sandy Berger. And he isn't talking.

Why should he talk? He got away with it cold. Or, more precisely, the Bush administration allowed him to get away with it.

I think my real disillusionment with this administration, my first outbreak of BDS, if you will -- began with Sandy Berger.

Until then, I had managed to rationalize away all the other boneheaded administration moves I kept seeing out of sheer loyalty to the idea of a Republican presidency -- but there was just no way I could swallow this.

There is just no earthly reason I can possibly accept for the Bush Justice Department to ignore such a blatantly criminal misuse of power and privilege.

We'll never know, that's for sure. Given what he risked to pull this off, and given the common knowledge about what happens to those people who cross the Clintons, he will take whatever secret he managed to save with him to the grave.

It will always bother me is that Berger stole what is a piece of United States history. There will always be a question mark regarding Clinton’s actions to combat terrorism in the late 90’s. It will always be “historians will argue...” And that’s a shame.

“The Sept. 11 commission did not learn of any U.S. government knowledge prior to 9/11 of surveillance of Mohammed Atta or of his cell,” said Hamilton, a former Democratic congressman from Indiana. “Had we learned of it obviously it would’ve been a major focus of our investigation.”

Hamilton’s remarks Tuesday followed findings by Rep. Curt Weldon, R-Pa., vice chairman of the House Armed Services and Homeland Security committees, that made front-page news.

In June, Weldon displayed charts on the floor of the U.S. Senate showing that Able Danger identified the suspected terrorists in 1999. The unit repeatedly asked for the information to be forwarded to the FBI but apparently to no avail. Various news outlets picked up on the story this week.

Weldon said that in September 2000, the unit recommended on three separate occasions that its information on the hijackers be given to the FBI “so they could bring that cell in and take out the terrorists.” However, Weldon said Pentagon lawyers rejected the recommendation, arguing that Atta and the others were in the country legally so information on them could not be shared with law enforcement.

“Lawyers within the administration — and we’re talking about the Clinton administration, not the Bush administration — said ‘you can’t do it,’” and put post-its over Atta’s face, Weldon said. “They said they were concerned about the political fallout that occurred after Waco … and the Branch Davidians.”

Well, look now to what the 9/11 report has to say about the man to whom President Clinton, under attack by an independent counsel,delegated so much in respect of national security, Samuel “Sandy” Berger. The report cites a 1998 meeting between Mr. Berger and the director of central intelligence, George Tenet, at which Mr. Tenet presented a plan to capture Osama bin Laden.

“In his meeting with Tenet, Berger focused most, however, on the question of what was to be done with Bin Ladin if he were actually captured. He worried that the hard evidence against Bin Ladin was still skimpy and that there was a danger of snatching him and bringing him to the United States only to see him acquitted,” the report says, citing a May 1, 1998, Central Intelligence Agency memo summarizing the weekly meeting between Messrs. Berger and Tenet.

In June of 1999, another plan for action against Mr. bin Laden was on the table. The potential target was a Qaeda terrorist camp in Afghanistan known as Tarnak Farms. The commission report released yesterday cites Mr. Berger’s “handwritten notes on the meeting paper” referring to “the presence of 7 to 11 families in the Tarnak Farms facility, which could mean 60-65 casualties.”According to the Berger notes, “if he responds, we’re blamed.”

On December 4, 1999, the National Security Council’s counterterrorism coordinator, Richard Clarke, sent Mr. Berger a memo suggesting a strike in the last week of 1999 against Al Qaeda camps in Afghanistan. Reports the commission: “In the margin next to Clarke’s suggestion to attack Al Qaeda facilities in the week before January 1, 2000, Berger wrote, ‘no.’ ”

In August of 2000, Mr. Berger was presented with another possible plan for attacking Mr. bin Laden.This time, the plan would be based on aerial surveillance from a “Predator” drone. Reports the commission: “In the memo’s margin,Berger wrote that before considering action, ‘I will want more than verified location: we will need, at least, data on pattern of movements to provide some assurance he will remain in place.’ ”

In other words, according to the commission report, Mr. Berger was presented with plans to take action against the threat of Al Qaeda four separate times — Spring 1998, June 1999, December 1999, and August 2000. Each time, Mr. Berger was an obstacle to action. Had he been a little less reluctant to act, a little more open to taking pre-emptive action, maybe the 2,973 killed in the September 11, 2001, attacks would be alive today.

I recently had the opportunity to ask Congressman Tancredo this very question. He indicated that the Justice Dept. is still infested with Clinton, and even Carter, holdovers.

Here’s the bottom line:

Given the severity of the crime that Berger committed,

it’s obvious that NOT stealing those documents would have had FAR GREATER CONSEQUENCES than the punishment for stealing them.

Since 9-11, the Bush Administration has had their hands full dealing with the war on terror while facing a constant barrage of attacks from the left and complicit media (but I repeat myself). As much as I'd like to see every Clinton crony prosecuted and jailed for their failings and cover ups, I appreciate the administration directing energies toward protecting us via intelligence, policies, and preemptive attacks.

What is at stake is more than what we think and say about Sandy Berger. It is more than the legacy of Bill Clinton and of George W. Bush. It is more than the prospects for Hillary Clinton becoming the Democrats' presidential nominee and ultimately the President. All of these, of course, are wrapped up in this story.

Our security and vitality of the rule of law in America are at stake as well. That should concern all whose lives and loved ones may be at risk if our nation follows the wrong path, not knowing everything that should inform our judgments. It should concern all who respect the law, all who have labored as lawyers and judges, as honorable government officials and voices for even-handed justice.

Confidence in our ability to govern ourselves erodes when high ranking POS like Sandy Berger walks in lockstep with a Just Us Department. Great men and women have given their lives for this?

A very interesting development. Obviously, he had far more to lose by retaining his license. And it hopefully ends whatever speculation there might have been for him to return to public office under any administration.

It saddens me to read the attacks on the President here on FR. His administration may not have been able to get to the whole truth behind the Berger/Clinton story but I don’t think anyone could have.

Do you think for one moment if it had been Karl Rove doing the same thing that the Democrats would have shuffled it under the rug like this?

The Bush administration did SHUFFLE IT UNDER THE RUG. They make it go away just as quickly and as quietly as they possibly could.

Worse, the Bush Administration seems to go out of their way to avoid having anything of substance from the Clinton years surface.

If I were the paranoid type, I'd wonder why W covers for them....

Many Repubs took note; apparently not the one's that mattered however. Did our Congressional Repub Leadership take note (beyond a lone voice or two)?

In hindsight, I note that the Republicans were complying with Democrats on this while the Democrats were secretly keeping information on Mark Foley until just the right time to dump it on the mid-term elections and swing Congress to the Democrats.

When will Republicans learn to never trust the Democrats? What did it get them? They "saved" Sandy Berger and got backstabbed in Congress anyway.

Yup and just yesterday I had the opportunity to corner a bunch of represenatives for the presidential candidates and ask them why Republicans have failed to use the energy issue in this campaign against Democrats.

For a while they misinterpreted my question to mean that I was interested in their candidates position regarding energy and I corrected all of them and emphasized that I was asking from the standpoint of a Republican being interested in defeating Democrats in elections and wondering why they have failed to use the issue. This is a winning issue IF we keep beating the idiot voters over their heads that it is the DEMOCRATS who are blocking new production of oil and the building of refineries.

I pointed out that Republicans have earned the title of the "Stupid" party.
