You sound like you are (1) reading it backwards; (2) generalizing from Texas to the whole USA.
Reading what backwards? I only talk about Texas because that is all that I know about based on 30 years experience. I generally leave it up to other people to talk about other state’s laws (unless I have the time and inclination to read up on them).
