They could charge him with health care fraud resulting in death, which carries anything from a few years to a life sentence if convicted, I doubt they will though.

Benoits sick crimes took place over 3 days, and appear to methodical and to well planned for any kind of "roid rage" type of prosecution.
The good doc, could get nailed for alot of things, but no chance of a murder charge.
