Second, the attorney seems to be going out of his way to mitigate the content of the pics. However, the article is quite clear it isn’t the pics themselves that seem to be the scandalous issue, but the captions written alongside them. The pics could be something rather pedestrian like bikini shots, however, if they are accompanied with ribald or graphic comments, and they are in her handwriting, well that could be a problem. There claim that the pics look to be tampered with signals there initial defense when they are made public is that although the pics are hers, the captions are not. Might be a sticky wicket if it was a private posting site only she had access to.
Third, I’m not sure this could be a legal blackmail situation. Let’s say the pics and captions are legitimate, the perp might be a pageant supporter who wishes to see it avoid a messy scandal. Sending a message to the effect “There are compromising pictures of you that you are aware of that may be made public. For the good of the pageant and your own reputation, I strongly urge you step down to avoid a he potential of a messy and damaging scandal for yourself and the pageant.”
Notice, they didn’t demand money.
“Extortion” is the act of using biographical leverage to obtain favor or payment.
“Blackmail” is the act of payment.
You’d think a journalism student would know the difference.
